Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

This collection of information involves the mandatory reporting and recordkeeping of maintenance, major modifications, repairs, and alterations performed on U.S. civil registered aircraft. The reporting and maintenance recording required by FAR 43 may only be done by certified mechanics, repair stations, and air carriers authorized to perform maintenance. Pilots are also authorized to perform and record preventive maintenance, however, the authorization applies only to those pilots who own or lease their aircraft for private operation for preventative maintenance only. The reporting and maintenance recordkeeping requirements of FAR 43 is a ongoing process and initiated on occasion as needed at the time of maintenance, preventive maintenance, rebuilding and alteration of an aircraft airframe, aircraft engine, propeller, or appliance. All information on completed 337 forms are submitted to FAA division AFS-750 through electronic process or paper copy. Information collected is aircraft data arranged by registration “N” number, owner name and address, with certificate number of the person accomplishing the work. The form also contains detailed information of the work accomplished. The information is then recorded in the aircraft official database record to be kept indefinitely. This is accomplished to enhance safety by ensuring quality workmanship and parts are utilized for the continued operational safety of the flying public and passengers aboard the aircraft and on the ground. This information is collected for all aircraft undergoing maintenance, repair or alteration. Some allowances have been given to FAR part 121 air carriers to authorize an alternative method of reporting major repairs and alterations. This alternative method is a record keeping system approved by the local office through company procedures to maintain and approve the repairs and alterations for their aircraft in a permanent record. This is only accomplished by 80% of the certificated air carriers. The remaining 20 % still utilize Form 337 for these modifications to their aircraft under their operational authority.

Abstract

Rule 10b-10 under the Securities Exchange Act of 1934 ("Exchange Act") requires broker-dealers to disclose basic trade information to customers regarding their securities transactions. The information required by Rule 10b-10 includes: the date and time of the transaction, the identity and number of shares bought or sold, and the trading capacity of the broker-dealer. In addition, depending on the trading capacity of the broker-dealer, the Rule requires the disclosure of commissions and, under specified circumstances, mark-up and mark-down information. For transactions in debt securities (other than U.S. savings bonds and municipal securities) the Rule requires the disclosure of redemption and yield information. For transactions in securities futures products in a futures account, the Rule permits alternative information disclosure requirements. This alternative information includes, the date the transaction was executed; the identity and number of shares bought or sold; the price, the delivery month, and the exchange on which the transaction was executed; the source and amount of broker remuneration; whether the broker received payment for order flow; and, the fact that other specified information about the execution of the transaction will be available upon written request. Rule 10b-10 also requires broker-dealers to inform their customers if they are not members of the Securities Investor Protection Corporation ("SIPC"). The purpose of this disclosure is to ensure that customers are not led to believe that their accounts are subject to SIPC protection when they are not. In addition, the Rule requires broker-dealers to state on confirmations whether they receive payment for order flow. The confirmation has become a customary tool in the industry, and it serves several functions: firms use it as a billing statement; it serves as a customer invoice; it informs investors of the details of a transaction allowing the customer to check for errors or misunderstandings; it provides consumer information, allowing investors to evaluate the cost and quality of the services provided by broker-dealers; it discloses possible conflict of interest that may arise between the investor and broker-dealer; and it safeguards against fraud, by permitting the customer to detect problems associated with a transaction.

New proposed rule 17a-14 under the Exchange Act [17 CFR 240.17a-14] and Form CRS [17 CFR 249.640] would require a broker-dealer that offer services to retail investors to prepare, file with the Commission, post to the broker-dealer’s website (if it has one), and deliver to retail investors a relationship summary, as discussed in greater detail in Section II above. Broker-dealers would file the relationship summary with the Commission's Electronic Data Gathering, Analysis, and Retrieval system. Broker-dealers also would be required to deliver the relationship summary to both existing customers and new or prospective new customers who are retail investors. New proposed rule 17a-14 under the Exchange Act [17 CFR 240.17a-14] and Form CRS [17 CFR 249.640] contain a collection of information requirement. We will use the information to manage our regulatory and examination programs. Clients can use the information required in Form CRS to determine whether to hire or retain a broker-dealer, as well as what types of accounts and services are appropriate for their needs. The collection of information is necessary to provide broker-dealer customers, prospective customers, and the Commission with information about the broker-dealer and its business, conflicts of interest and personnel. This collection of information would be found at 17 CFR 240.17a-14 and 17 CFR 249.640 and would be mandatory. Responses would not be kept confidential.

Abstract

The NRC's regulations in part 11 of title 10 of the Code of Federal Regulations (10 CFR), establish requirements for access to special nuclear material, and the criteria and procedures for resolving questions concerning the eligibility of individuals to receive special nuclear material access authorization. The specific part 11 requirements covered under this OMB clearance include requests for exemptions to part 11 requirements, amendments to security plans that require incumbents to have material access authorizations, access authorization cancellations. In addition, licensees must keep records of the names and access authorization numbers of certain individuals assigned to shipments of special nuclear material. The information required by 10 CFR part 11 is needed to establish control over and maintain records of who is properly authorized to safeguard and have access to special nuclear material. Not knowing this information could cause harm to the public and national security.

CMS promulgated 42 CFR 424.570 in order to comply with that statute, which requires that prior to implementing state Medicaid moratoria the state Medicaid agency must notify the Secretary in writing , including all of the details of the moratoria, and obtain the Secretary’s concurrence with the imposition of the moratoria. Key Information

Abstract

The U.S. Geological Survey (USGS) is responsible for tracking the status and distribution of introduced aquatic organisms. The purpose of the Nonindigenous Aquatic Species Program (NAS) is to monitor and provide information concerning the status, distribution and potential impacts of non-native aquatic organisms in a timely manner for research, management and education. Information is collected from the public regarding the distribution of nonindigenous aquatic species, primarily fish, in open waters of the United States. This information is vital for early detection and rapid response for the possible eradication of organisms that may be considered invasive in a natural environment such as a lake, river, stream, and pond. These species are not native to the environment in which they are now found. Nonindigenous species can and do have negative impacts on our natives species. Early detection is a major focus of the Bureau. The public can help us with this task by serving as the “eyes and ears” for our Program because the USGS cannot possibly be everywhere, observing and monitoring all open waters for nonindigenous aquatic species.

Abstract

These requirements in part 135 are addressed specifically to helicopter air ambulances, often referred to as emergency medical services (EMS), and to on-demand operations including overwater operations. The National Transportation Safety Board recommended several changes following accident investigations. The FAA aims to improve the safety record of helicopter air ambulances through better oversight of their operations. The FAA will use the information it collects and reviews to ensure compliance and adherence with regulations and, if necessary, to take enforcement action on violators of the regulations. Section 44731 of the Modernization and Reform Act of 2012 required the FAA to collect from part 135 certificate holder providing helicopter air ambulance services a report containing the number of helicopters that the certificate holder uses to provide helicopter air ambulance services, the base locations of the helicopters, the number of flights and hours flown by registration number while providing helicopter air ambulance services, the number of flight requests for a helicopter providing air ambulance services that were accepted or declined by the certificate holder and the type of each such flight request (such as scene response, inter-facility transport, organ transport, or ferry or repositioning flight), the number of accidents, if any, involving helicopters operated by the certificate holder while providing air ambulance services and a description of the accidents, the number of flights and hours flown under instrument flight rules by helicopters operated by the certificate holder while providing air ambulance services, the time of day of each flight flown by helicopters operated by the certificate holder while providing air ambulance services, and the number of incidents, if any, in which a helicopter was not directly dispatched and arrived to transport patients but was not utilized for patient transport. Section 314(d) of the FAA Reauthorization Act of 2018 amended these reporting requirements for the report to contain the number of helicopters that the certificate holder uses to provide helicopter air ambulance services and the base locations of the helicopters, the number of hours flown by the helicopters operated by the certificate holder, the number of patients transported and the number of patient transport requests for a helicopter providing air ambulance services that were accepted or declined by the certificate holder and the type of each such flight request (such as scene response, inter-facility transport or organ transport), the number of accidents, if any, involving helicopters operated by the certificate holder while providing air ambulance services and a description of the accidents, the number of hours flown under instrument flight rules by helicopters operated by the certificate holder, the number of hours flown at night by helicopters operated by the certificate holder, the number of incidents, if any, in which a helicopter was not directly dispatched and arrived to transport patients but was not utilized for patient transport. Essentially, this relieved the requirement for reporting of flight time by individual aircraft and by time of day and now only requires the reporting of the total flight hours, in aggregate, flown by the certificate holder and the number of hours flown at night. The amendment added the requirement to report the number of patients flown by the certificate holder. The requirement for reporting is placed upon the certificate holders via Operations Specification paragraph A021, Air Ambulance Operations—Helicopter. A reporting template is provided to the certificate holders by the Air Transportation Division, Operations Group, 135 Air Carrier Operations Section, AFS-220.

Abstract

The information collected is used by the FAA, Noise Division of the Office of Environment and Energy, to issue special flight authorizations for nonrevenue operations of transports and non-transport jet, Stage 2 airplanes at U.S. airports. The operators of such noisier airplanes that seek specific operations into U.S. airports must fill out an SFA form to request FAA approval. The collection of this information is mandatory and must be reported by operators when they need a special flight authorization after 12/31/2015. Minimal data is requested to identify the affected parties and determine whether the purpose for the flight is one of the ones enumerated in the law. The collection of information is on occasion and follows the circumstances enumerated in the law. The submitted data, about requested flight departure and arrival airports that match the purpose of flight, is used to attest to such authorized flight operations in the case of audit by FAA enforcement personnel. The FAA maintains in records the original request information. FAA form 1050-8 exists to minimize operator and FAA workload; intended to get all the information at one time in most cases (avoid repeated contacts to issue one special flight authorization).

Abstract

In the final rule, the Patient Protection and Affordable Care Act; HHS Notice of Benefit and Payment Parameters for 2017 (CMS-9937-F), we finalized 45 CFR 156.1256, which requires QHP issuers, in the case of a material plan or benefit display error included in 45 CFR 155.420(d)(12), to notify their enrollees of the error and the enrollees’ eligibility for a special enrollment period within 30 calendar days after the issuer is informed by an Federally- facilitated Exchange (FFE) that the error is corrected, if directed to do so by the FFE. This requirement provides notification to QHP enrollees of errors that may have impacted their QHP selection and enrollment and any associated monthly or annual costs, as well as the availability of a special enrollment period under §155.420(d)(12) for the enrollee to select a different QHP, if desired.
