Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

Existing directives in the Forest Service Manual and Handbook are being revised to improve security and administration of explosive magazines and explosives use that are authorized under a special use authorization. The revisions clarify that all non-Forest Service storage and use of explosives, including use and storage of military weapons and ammunition for purposes of avalanche mitigation on National Forest System lands, must be authorized by a special use authorization that contains clause B-29 in Forest Service Handbook 2709.11, Chapter 50, section 52.2, on storage and use of explosives and magazine security. Clause B-29 requires authorization holders to comply with applicable United States Department of Justice, Bureau of Alcohol, Tobacco, Firearms and Explosives, state, or Department of the Army requirements and applicable Forest Service requirements. To allow the Forest Service to monitor holder compliance with clause B-29, the revised directives require holders of an authorization containing the clause to submit certain documentation annually as part of their operating plan. The required documentation includes copies of a log containing the date and type of magazine inspections (including inspections required every seven days) and the date all deficiencies identified in any magazine inspection report were corrected; copies of any magazine inspection reports; a copy of the holder's current ATF-issued federal explosives license or federal explosives permit, if applicable; and a copy of a log containing the date of the most recent magazine lock and key replacement.

The Office of Workers' Compensation Programs (OWCP) administers the Federal Employees' Compensation Act (FECA). A Peace Corps Volunteer who sustains an injury or contracts an illness overseas while in Peace Corps service may be entitled to benefits under the FECA. The Department of Labor authorizes the Peace Corps to furnish medical benefits to a volunteer, who is injured during the volunteer’s period of service, for a period of 120 days following termination if the service volunteer’s injury meets requirements.

Community Wildfire Defense Grant Program

Key Information

Abstract

The Community Wildfire Defense Grant Program forms will be used by applicants to apply for the Community Wildfire Defense Grant (CWDG) Program. The purpose of the CWDG Program is to assist at-risk local communities and Indian Tribes with planning and mitigating against the risk created by wildfire. This program is authorized in the Infrastructure Investment and Jobs Act (P.L. 117-58), commonly referred to as the Bipartisan Infrastructure Law (BIL). Specifically, the CWDG Program is provided for in Title VIII, Section 40803. There are two primary project types for which the grant provides funding: the development and revision of Community Wildfire Protection Plans (CWPP) and the implementation of projects described in a CWPP that is less than ten years old. The Act prioritizes at-risk communities that are in an area identified as having high or very high wildfire hazard potential, are low-income, and/or have been impacted by a severe disaster.

Prevention of Significant Deterioration and Non-Attainment New Source Review (Renewal)

Key Information

Abstract

This ICR is for activities related to the implementation of the EPAs New Source Review (NSR) program, and renews the previous ICR. Title I, part C of the Clean Air Act (CAA or the Act)Prevention of Significant Deterioration, and part DPlan Requirements for Nonattainment Areas, require all states to adopt preconstruction review programs for new or modified stationary sources of air pollution. In addition, the provisions of section 110 of the Act include a requirement for states to have a preconstruction review program to manage the emissions from the construction and modification of any stationary source of air pollution to assure that the National Ambient Air Quality Standards are achieved and maintained. Tribes may choose to develop implementation plans to address these requirements. Implementing regulations for these three programs are promulgated at 40 CFR 49.101 through 49.105; 40 CFR 49.151 through 49.173; 40 CFR 51.160 through 51.166; 40 CFR part 51, Appendix S; and 40 CFR 52.21 and 52.24. In order to receive a construction permit for a new source or modification, the applicant must conduct the necessary research, perform the appropriate analyses and prepare the permit application with documentation to demonstrate that the project meets all applicable statutory and regulatory NSR requirements. Specific activities and requirements are listed and described in the Supporting Statement for the ICR. State, local, tribal or federal reviewing authorities review permit applications and provide for public review of proposed projects and issue permits based on their consideration of all technical factors and public input. The EPA, more broadly, reviews a fraction of the total applications and audits the state and local programs for their effectiveness. Consequently, information prepared and submitted by sources is essential for sources to receive permits, and for federal, state, and local environmental agencies to adequately review the permit applications and thereby properly administer and manage the NSR programs.

Abstract

This information collection request (ICR) is a revision of a currently approved information collection under OMB control number 2132-0579 “National Transit Asset Management (TAM) System.” This information collection reflects an increase in respondents but an overall decrease in responses and total annual burden hours. A slight increase in Tier II grantees increased the total annual respondents, however the total number of responses decreased as nearly 75% of Tier II grantees participate in a group plan. The first TAM plans were completed in October 2018 and under the prior approval in 2020, many of the plans were still being drafted. Now that they are done, the initial burden of collecting new information has decreased. The entities that must respond are Tier I (large transit agencies) and Tier II (small transit agencies). Tier I providers are recipients that own, operate, or manage either 1-101 or more vehicles in revenue service during peak regular service across all fixed route modes or in any one non-fixed route mode, or operate rail transit. Tier II providers are entities that 1.) operate 1-100 or fewer vehicles in revenue service during peak regular service across all non-rail fixed route modes or in any one non-fixed route mode, 2.) a sub recipient under the 5311 Rural Area Formula Program, or 3.) are considered an American Indian tribe. Both of these respondents were included in the initial IC submission in 2016. The response to the collection is required to obtain or retain a benefit, as all recipients and sub-recipients of Chapter 53 funds that own, operate, or manage public transportation capital assets must develop TAM plans. This information collection is to be maintained on a yearly basis and submitted every four years. That data is submitted to FTA during the submission of their performance measures and targets electronically into the National Transit Database.

This information collection (IC) request is a revision to a currently approved collection under OMB control number 2132-0500 “49 USC Section 5310-Capital Assistance Program for Elderly Persons and Persons w/Disabilities & Section 5311-Nonurbanized Area Formula Program.” There are no programmatic changes to this information collection from the 2020 information collection. However, there was a decrease in the number of Section 5310 competitive applicants and a decrease in the number of Indian Tribes participating in the Tribal Transit program. In 2020 there were 523 respondents. In this information collection is a decrease of 6 respondents for a total of 517 (5310 and 5311) grantees. As a result, there is a corresponding decrease in burden hours from 54,727 to 54,133. The response to the collection is required to obtain or retain a benefit, as the information is required to obtain to federal assistance to states, local governments, private nonprofit agencies, and public bodies through the Section 5310 and 5311 programs. The 5310 program provides private nonprofit groups funding to meet transportation needs of older adults and people with disabilities when the transportation service provided is unavailable, insufficient, or inappropriate in rural and small urban areas. The 5311 program provides capital, planning, and operating assistance to states to support public transportation in rural areas with populations of less than 50,000, where many residents often rely on public transit to reach their destinations. Eligible recipients include states and federally recognized Indian Tribes. Sub-recipients may include state or local government authorities, nonprofit organizations, and operators of public transportation or intercity bus service. Since States administer many of these programs they submit consolidated annual applications and milestone/financial reports to FTA on behalf of the sub recipients. The information reported includes project budget, description of the project, implementation plans, management plans, financial reports and progress reports. Sub-recipients typically do not report any information directly to FTA but are required by the State or designated recipient to provide sufficient information for reporting purposes.

Abstract

This information collection (IC) request is for a three-year extension with a revision to a currently approved information collection under OMB control number 2132-0576. This revision includes a decrease in the respondent universe as a result of updated data provided by eligible recipients in the annual National Transit Database. The respondent universe decreased from 1,885 in 2020 to 1,035 in this 2023 current information collection request (ICR). Therefore, there was a corresponding decrease in total burden hours. The other change associated with this ICR, is a change in the information collection name. During the 2022 annual update of the federal Assistance Listings FTA requested and received approval from OMB to change the grant program name of the FTA bus program to reflect the eligibility of transit providers to purchase or lease zero-emission and low-emission transit buses as well as the acquisition, construction, and leasing of required supporting facilities. This updated title, allows eligible recipients to easily search for federal funding opportunities associated with zero-emission and low-emission buses. Therefore, this IC submittal also reflects a change in the name of the information collection to Buses and Bus Facilities Formula, Competitive, and Low or No Emissions Programs to ensure consistency across the federal-wide reporting purposes. The response to the collection is required to obtain or retain a benefit, as the information is required to obtain federal funding assistance that help States and designated recipients to replace, rehabilitate and purchase buses and related equipment and to construct bus-related facilities including technological changes or innovations to modify low or no emission vehicles or facilities. Eligible recipients include designated recipients that operate fixed route bus service or that allocate funding to fixed route bus operators; state or local governmental entities; and federally recognized Indian tribes that operate fixed route bus service that are eligible to receive direct grants under 5307 and 5311. Eligible transportation providers must apply to receive federal funds and then provide milestone and financial reports as necessary to ensure the proper and timely expenditure of federal funds within the scope of the approved project.

Abstract

The publication of the Patient Protection and Affordable Care Act (PPACA), section 6405 - "Physicians Who Order Items or Services Required to be Medicare Enrolled Physicians or Eligible Professionals" (regulation CMS 6010-F), contains a requirement for certain physicians and non-physician practitioners to enroll in the Medicare program for the sole purpose of ordering or referring items or services for Medicare beneficiaries. The PPACA has an effective date applicable to written orders and certifications made on or after July 1, 2010. The CMS 855O allows a physician to receive a Medicare identification number (without being approved for billing privileges) for the sole purpose of ordering and referring Medicare beneficiaries to Medicare approved providers and suppliers. This new Medicare application form allows physicians who do not provide services to Medicare beneficiaries to be given a Medicare identification number without having to supply all the data required for the submission of Medicare claims. It also allows the Medicare program to identify ordering and referring physicians without having to validate the amount of data necessary to determine claims payment eligibility (such as banking information), while continuing to identify the physician's credentials as valid for ordering and referring purposes.

Proposed §156.230(e)(1) would require that QHP issuers make a good faith effort to provide written notice of discontinuation of a provider 30 days prior to the effective date of the change or otherwise as soon as practicable, to enrollees who are patients seen on a regular basis by the provider or who receive primary care from the provider whose contract is discontinuing. This is a third-party disclosure requirement. CMS is not proposing to collect this notice from QHP issuers in FFMs, therefore we are not specifying ways in which we will use the data. The purpose of this notice is to provide consumers information on when their providers will no longer be available in-network in their QHP. In proposed 156.230(f)(2), we require QHP issuers to provide a notice to enrollees of the possibility of out-of-network charges from an out-of-network provider in an in-network setting at least 10 calendar days prior to the service being provided to avoid counting the out-of-network costs against to the annual limitation on cost sharing.

This information collection comprises the following reports: • Debit Card Issuer Survey (FR 3064a) collects data from issuers of debit cards (including general-use prepaid cards) that, together with their affiliates, have assets of $10 billion or more, including information regarding the volume and value of debit card transactions; chargebacks and returns; costs of authorization, clearance, and settlement of debit card transactions; other costs incurred in connection with particular debit card transactions; fraud prevention costs and fraud losses; and interchange fee revenue. • Payment Card Network Survey (FR 3064b) collects data from payment card networks, including the volume and value of debit card transactions; interchange fees; network fees; and payments and incentives paid by networks to acquirers, merchants, and issuers. The data from the FR 3064a and FR 3064b are used to fulfill a statutory requirement that the Board disclose certain information regarding debit card transactions on a biennial basis.3 In addition, the Board uses data from the Payment Card Network Survey (FR 3064b) to publicly report on an annual basis the extent to which networks have established separate interchange fees for exempt and covered issuers.

Abstract

The CFTC requests the extension without change of the OMB clearance for the information collections associated with Part 160 of the Commission's regulations (Privacy of Consumer Financial Information). The passage of the Dodd-Frank Wall Street Reform and Consumer Protection Act, Public Law 111-203, 124 Stat. 1376 (2010), broadened the Commission's regulatory authority under the Gramm-Leach-Bliley Act ("GLB Act") to cover two new entities: Swap Dealers and Major Swap Participants, in addition to Futures Commission Merchants, Commodity Trading Advisors, Commodity Pool Operators, and Introducing Brokers, Specifically, amendments to the GLB Act found in section 1093 of the Dodd-Frank Act, reaffirmed the Commission's authority to promulgate regulations to require entities that are subject to the Commission's jurisdiction to provide certain privacy protections for consumer financial information. These regulations were later extended to Retail Foreign Exchange Dealers. Section 124 of the Commodity Futures Modernization Act of 2000 (“CFMA”) amended the Commodity Exchange Act (the “Act”) and added a new Section 5g to the Act to (i) add that futures commission merchants, commodity trading advisors, commodity pool operators, and introducing brokers that are subject to CFTC jurisdiction with respect to any financial activity shall be treated as a financial institution for purposes of Title V, Subtitle A of the Gramm-Leach-Bliley Act (“GLB Act”), (ii) treat the Commission as a Federal functional regulator for purposes of applying the provisions of the GLB Act, and (iii) direct the Commission to prescribe regulations under Title V of the GLB Act. The Commission adopted regulations for these entities under part 160 and later extended them to retail foreign exchange dealers, swap dealers, and major swap participants. Part 160 requires those subject to the regulations, among other things, to provide privacy and opt out notices to customers and to adopt appropriate policies and procedures to safeguard customer records and information.

This information collection (IC) request is for a three-year extension with a revision to a currently approved collection under OMB control number 2132-0577 “49 U.S.C. State of Good Repair.” The response to the collection is required to obtain or retain a benefit, as the information is submitted to FTA to provide capital assistance for the maintenance, replacement, and rehabilitation projects of high-intensity fixed guideway and bus systems to help transit agencies maintain assets in a state of good repair. Eligible recipients are state and local government authorities in Urbanized Areas (UZAs) with fixed guideway and high intensity motorbus systems in revenue service for at least seven years. The recipients must apply to receive federal funds and then provide various reports (milestone and financial reports) as necessary to ensure the proper and timely expenditure of federal funds within the scope of the approved project. This information is collected on yearly basis. That information is submitted to FTA's regional and headquarters staff via an application in GRANTS.gov and once awarded information is submitted into FTA’s electronic Transit Award Management System (TrAMS). This request includes an increase in respondents’ due to new applications received and an increase in burden hours proportionally.
