Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

47 CFR 76.54(c) is used to notify interested parties, including licensees or permittees of television broadcast stations, about audience surveys that are being conducted by an organization to demonstrate that a particular broadcast station is eligible for significantly viewed status under the Commission's rules. The notifications provide interested parties with an opportunity to review survey methodologies and file objections. Section 76.5 4(b) and 76.54(d) propose to apply their rules to satellite carriage. 47 CFR 76.54(e) and (f), if adopted, would be used to notify television broadcast stations about the retransmission of significantly viewed signals by a satellite carrier into these station's local market.

State Water Resources Research Institute Program Annual Application. National Competitive Grants and Reporting

Key Information

Abstract

The Water Resources Research Act of 1984, as amended (42 USC 10301 et seq.), authorizes a research institute water resources or center in each of the 50 States, the District of Columbia, Puerto Rico, the U.S. Virgin Islands, Guam, the Federated States of Micronesia, the Commonwealth of the Northern Marina Islands, and American Samoa. There are currently 54 such institutes, one in each State, the District of Columbia, Puerto Rico, the U.S. Virgin Islands, and Guam. The institute in Guam is a regional institute serving Guam, the Federated States of Micronesia, and the Commonwealth of the Northern Mariana Islands. Each of the 54 institutes submits an annual application for an allotment grant and provides an annual report on its activities under the grant. The State Water Resources Research Institute Program issues an annual call for applications from the institutes to support plans to promote research, training, information dissemination, and other activities meeting the needs of the States and Nation. The program also encourages regional cooperation among institutes in research into areas of water management, development, and conservation that have a regional or national character. The U.S. Geological Survey has been designated as the administrator of the provisions of the Act.

Abstract

The Freight Logistics Optimization Works (FLOW) Project address the U.S. supply chain issues that have been unprecedented over the past several years. These supply chain issues have contributed to the congestion under COVID-induced surges of containerized cargo through our ports and intermodal networks. In March of this year, the White House announced the launch of the Freight Logistics Optimization Works (FLOW) initiative with the Department of Transportation and the freight industry to facilitate a collaboration and sharing of intermodal trade data. This collaboration will help improve supply chain efficiencies and reduce overall costs to U.S. consumers. The FLOW initiative builds on previous work by the Administration's Supply Chain Disruptions Task Force to ensure the expeditious movement of cargo from ship to shelf.

Abstract

On October 24, 2018, the Commission released a Report and Order, FCC 18-149 in GN Docket No. 17-158, adopting limited changes to the rules governing Priority Access Licenses (PALs) in the 3550-3700 MHz (3.5 GHz) band, including larger license areas, longer license terms, renewability, and performance requirements. The Commission anticipated that the targeted changes made in its 2018 Report and Order will spur additional investment and broader deployment in the band, promote robust and efficient spectrum use, and help ensure the rapid deployment of advanced wireless technologies—including 5G—in the United States. The rule changes and information requirements contained in the Commission’s previous 3.5 GHz band orders—the 2015 Report and Order, FCC 15-47, and 2016 Order on Reconsideration and Second Report and Order, FCC 16-55, both in GN Docket No. 12-354—are also approved under this Office of Management and Budget (OMB) control number (3060-1211) and have not changed since OMB last approved them. Please see the previous OMB approvals for this collection to identify what else is covered by this collection. This supporting statement discusses only the performance requirements from the 2018 Report and Order. The Commission seeks approval from OMB for the information collection requirements contained in the 2018 Report and Order, FCC 18-149, stemming from the changes made to section 96.25(b) of it rules. The Commission revised section 96.25(b) to adopt performance requirements for Priority Access Licensees. Specifically, under the revised rule, Priority Access Licensees must provide substantial service in their license area by the end of the initial license term, i.e., at the end of 10 years. “Substantial service” is defined as service which is sound, favorable, and substantially above the level of mediocre service which might minimally warrant renewal. Failure by any licensee to meet this requirement will result in forfeiture of the license without further Commission action, and the licensee will be ineligible to regain it. Licensees shall demonstrate compliance with the performance requirement by filing a construction notification with the Commission in accordance with section 1.946(d) of the Commission’s rules. The licensee must certify whether it has met the performance requirement, and file supporting documentation, including description and demonstration of the bona fide service provided, electronic maps accurately depicting the boundaries of the license area and where in the license area the licensee provides service that meets the performance requirement, supporting technical documentation, any population-related assumptions or data used in determining the population covered by a service to the extent any were relied upon, and any other information the Wireless Telecommunications Bureau may prescribe by public notice. A licensee’s showing of substantial service may not rely on service coverage outside of the PAL Protection Areas of registered Citizens Broadband Radio Service Devices (CBSDs) or on deployments that are not reflected in Spectrum Access System (SAS) records of CBSD registrations.

Abstract

The National Science Foundation (“NSF”) promulgated regulations at 45 CFR Part 670, to conserve and protect animals and plants native to Antarctica, pursuant to the Antarctic Conservation Act of 1978, Public Law 95-541 (“ACA”), as amended by the Antarctic Science, Tourism, and Conservation Act of 1996, Public Law 104-227 (16 USC 2401 et seq.). The regulations have been in effect since 1979 and apply to all United States citizens in Antarctica and to everyone importing into or exporting from the United States certain designated Antarctic animals and plants. Under the ACA and NSF’s regulations, a permit from NSF is required for entry into protected areas, taking of birds, mammals, and certain plants, introduction of non-indigenous plants and animals into Antarctica, and engaging in harmful interference with native plants, mammals, birds and invertebrates. NSF has used the Antarctic Conservation Act Application and Permit Form for many years to collect information for its permit administration.

Pacific Coast Groundfish Fishery Rationalization Social Study

Abstract

This request is for extension of a currently approved information collection. The Pacific Coast Groundfish Trawl Fishery was rationalized in January 2011. After a long history of management actions such as limited entry programs, buyback programs, and season and gear restrictions, catch shares was the next management option. While catch shares may have biological and economic benefits, literature has long documented extensive negative social and cultural impacts to related fishing communities. This study collects information to identify those sociocultural impacts, both in the short and long term. Community members are directly and voluntarily surveyed. Some impacts take years to be revealed, resulting in the need for ongoing monitoring. Other impacts such as ‘graying of the fleet’, crew impacts, changing women’s roles, and infrastructure changes have already been identified. Management has been directly informed of all these results, as well as the larger research community and the public. Additional impacts such as owner consolidation, processor access, and other potential impacts that have been identified in literature can only be identified in this fishery and under this management system by continued monitoring and admiration of this study.

Abstract

This is a request for extension of a currently approved information collection. Information requirements pursuant to the Coastal Zone Management Act (CZMA/the Act) are in fulfillment of statutory and regulatory requirements pertaining to State reviews of federal actions for consistency with State policies. The requirements apply to federal agencies (15 CFR part 930, subpart C); federal license and permit applicants (15 CFR part 930, subpart D); persons proposing outer continental shelf exploration, development and production plans (15 CFR part 930, subpart E); and State and local government applicants for federal financial assistance (15 CFR part 930, subpart F). Information submitted pursuant to the requirements under the Act and its implementing regulations informs States as to federal actions that may have reasonably foreseeable effects on uses or resources of the State coastal zone. Except in limited circumstances which are few in the number of instances in any given year, the NOAA Office for Coastal Management does not receive the information that federal agencies and applicants are required to provide to States pursuant to the federal requirements under the CZMA. DCIA Aging and Compliance Data Requirements for Guaranty Agencies

Abstract

The Department of Education (the Department) is requesting an extension of the currently approved Guaranty Agencies (GA) reporting requirements for Office of Management and Budget (OMB) approval. The reporting requirements include minor edits together with updated GA and FSA contacts. The Department is required to report to the U.S. Department of the Treasury (Treasury) the status and condition of its non-tax debt portfolio in accordance with the requirements of the Debt Collection Improvement Act of 1996 (DCIA) and the Digital Accountability and Transparency Act of 2014 (DATA Act). Receivable information is reported to Treasury via the Treasury Report on Receivables and Debt Collection Activities (previously called the TROR). The Department is unable to prepare an accurate and compliant Treasury Report based on the data it currently receives from its GAs. The continuing guidance requires the GAs to age debt according to DCIA; report the eligibility of DCIA-aged debt for referral to the Treasury Offset Program (TOP); and report compliance with Form 1099-C reporting. The updated document is titled DCIA Aging and Compliance Data Requirements for Guaranty Agencies (the Requirements). The Department plans to issue the Requirements to the GAs in Fiscal Year 2023. The data requirements for GA’s are not changing. The updated document includes minor edits together with updated GA and FSA contacts.

Abstract

The Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (Safety and Soundness Act), as amended by the Federal Housing Finance Regulatory Reform Act of 2008, Division A of the Housing and Economic Recovery Act of 2008, requires the Federal Housing Finance Agency (FHFA) to ensure that the operations and activities of each regulated entity foster liquid, efficient, competitive, and resilient national housing finance markets. Recognizing the significant effects that the regulated entities’ potential use of fintech products and innovations could have on the mortgage market and market participants, FHFA has an interest in learning about new and emerging technologies which may have applications in the mortgage space. To obtain information from the public, FHFA plans to conduct a series of competitions called “Tech Sprints.” The Tech Sprints will pose “problem statements” associated with fintech in the housing finance market and solicit innovative solutions from individuals and entities participating in the Tech Sprint. The Tech Sprint solutions will support the Agency in developing strategies for the regulated entities to advance housing finance fintech in a safe and sound, responsible, and equitable manner.

FERC-574, Gas Pipeline Certificates: Hinshaw Exemption

Abstract

The 3-year renewal of information collected by FERC-574 is a written application declaring the applicant's intent following the requirements set forth in 18 CFR 152. Although the FERC-574 application provides specific data per 18 CFR 152, the information is not collected on a prescribed or preformatted form. The application provides the information which the applicant must furnish the Commission in order to make a determination as to whether the application meets exemption provisions of Section 1(c) of the Natural Gas Act. It is used by the Commission's staff to research the jurisdictional aspects of the applicant's operations. Commission staff conducts a systematic review of the prepared application with supplemental documentation provided in the filing. The research includes examining maps and land ownership records to establish whether or not there is Federal jurisdiction. In addition, companies that are currently regulated by the Commission and change their status and wish to become non-jurisdictional, must document that they meet the criteria as provided for in Part 152. The required documents allow for a full and complete analysis of a company and provide sufficient data to make a jurisdictional decision. A finding of non-jurisdictional by the Commission can result in the elimination of a substantial paperwork burden for an applicant who might otherwise have to file to comply with sections 4 and 7 of the NGA. Failure to issue these requirements would mean the Commission is not meeting its statutory obligations under Sections 1(c), 4 and 7 of the NGA.

Abstract

A person owning or operating a natural gas pipeline facility is required to maintain records, make reports, and provide information to the Secretary of Transportation at the Secretary's request. This mandatory information collection request would require owners and/or operators of gas pipeline systems to make and maintain records in accordance with the requirements prescribed in 49 CFR Part 192 and to provide information to the Secretary of Transportation at the Secretary's request. Certain records are maintained for a specific length of time while others are required to be maintained for the life of the pipeline. PHMSA uses these records to verify compliance with regulated safety standards and to inform the agency on possible safety risks. This ICR is being revised to include new recordkeeping requirements contained in the Pipeline Safety: Safety of Gas Transmission Pipelines: Repair Criteria, Integrity Management Improvements, Cathodic Protection, Management of Change, and Other Related Amendments final rule, including the requirements under §§ 192.13(d), 192.319(g), 192.461(i), 192.461(h), 192.465(d)(2), 192.478(a), 192.478(c), 192.485(c), 192.714(c) ,192.714(d)(3), 192.714 (g), 192.917(b)(2), 192.927 (c)(2), 192.929(b), 192.929 (b)(4)(i), and 192.929 (b)(5).

Key Information

Abstract

This is an information request renewal (ICR) to the Office of Management and Budget (OMB) for IC# 2132-0008, “National Transit Database” information collection request (ICR), which is currently due to expire on January 31, 2023, and extend it for three years. This request is for a revision of a currently approved collection due to statutory requirements to increase the scope of data collected by the NTD. The change in this collection reflects an increase in total burden hours from 327,524 in the previous approved information collection to an annual total burden hours of 456,179. This increase is largely due to the Infrastructure Investment and Jobs Act (Pub. L. 117-58, the “Bipartisan Infrastructure Law”). At the same time, FTA made a number of enhancements that reduced the burden hours on NTD reporters, such as offering reporting waivers for agencies affected by COVID-19. The response to the collection is required to obtain or retain a benefit, as statute requires that recipients or beneficiaries of grants from the Federal Transit Administration (FTA) under the Urbanized Area Formula Program (§5307) or other than Urbanized Area (Rural) Formula Program (§5311) submit data to the NTD on an annual basis. The entities responding to this information collection are Rural, Urban, and Small/Tribal Transit Systems throughout the United States and Puerto Rico. Each respondent submits an annual report to FTA staff and contractors that includes an overview of the transit agency, asset inventory, safety event reporting, asset condition reporting, transit asset management program target reporting, etc.
