ICR Definition

An Information Collection Request (ICR) is a federal agency’s request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

Federal agencies are required to submit an ICR whenever they create, renew, modify, or discontinue an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

Section 16 of the Shipping Act of 1984, 46 U.S.C. 40103, authorizes the Federal Maritime Commission to exempt by rule “any class of agreements between persons subject to this Act or any specified activity of those persons from any requirement of this Act if it finds that the exemption will not result in substantial reduction in competition or be detrimental to commerce. The Commission may attach conditions to any exemption and may, by order, revoke any exemption.” The Commission added 46 CFR 531 to exempt non-vessel-operating common carriers (NVOCCs) from the more stringent tariff rate publication requirements of the Shipping Act of 1984 and related provisions of the Commission’s regulations to permit them to enter into contracts with shippers similar to ocean common carrier service contracts. 69 FR 75850 (Dec. 20, 2004). The exemption was conditioned upon the filing of NVOCC service arrangements (NSAs) with the Commission by the NVOCC offering the service; publication of the essential terms of NSAs; and confidential treatment of NSAs. In addition, NVOCCs were required to maintain NSAs and associated records for five years. In 2018, the Commission provided further relief of regulatory burdens on NVOCC by removing the NSA filing requirements effective August 22, 2018. (83 FR 34780) The filing exemption is conditioned upon the licensed NVOCC including a prominent notice invoking the exemption in its electronically published rules tariff and indicating their intention to the Commission. NVOCCs must continue to maintain original NSAs and associated records for 5 years in a format easily produced to the Commission, and provide those records promptly upon request from the Commission.

On April 3, 2012 the Commission adopted Commission regulations 23.600 (Risk Management Program), 23.601 (Monitoring of Position Limits), 23.602 (Diligent Supervision), 23.603 (Business Continuity and Disaster Recovery) 23.606 (General Information: Availability for Disclosure and Inspection), and 23.607 (Antitrust Considerations) pursuant to section 4s(j) of the Commodity Exchange Act (“CEA”). The above regulations adopted by the Commission would, among other things, require swap dealers (“SD”) and major swap participants (“MSP”) to develop a risk management program (including a plan for business continuity and disaster recovery and policies and procedures designed to ensure compliance with applicable position limits). The Commission believes that the information collection obligations imposed by the above regulations are essential to ensuring that swap dealers and major swap participants maintain adequate and effective risk management programs and policies and procedures to ensure compliance with position limits.

Abstract

The Training and Exchanges Automated Management System (TEAMS) is USAID's official data management system and the entry point for data for U.S. exchange visitor programs. TEAMS incorporates processes to manage and support EV's who will come to the U.S. on a USAID J-1 visa. TEAMS manages data by interfacing with the Department of Homeland Security's (DHS) Student and Exchange Visitor Information System (SEVIS), the system that DHS uses to maintain and monitor participants in U.S. programs. All EV's must be registered in SEVIS. USAID utilizes SEVIS to report on EV programs, and to issue Certificates of Eligibility for Exchange Visitor Status (Form DS-2019). The Automated Directive System (ADS) Chapter 252—Visa Compliance for Exchange Visitors, requires Agency operating units (OUs) or their Implementing Partners, in accordance with their awards, to enter data into TEAMS relevant to U.S. visits by sponsored foreign nationals who are recipients of USAID development assistance. TEAMS replaces the Training Results and Information Network (TraiNet) and Visa Compliance System (VCS). TEAMS combines the functionality of TraiNet and VCS into one system. Abstract

The purpose of this request is to renew the currently OMB approved ICR and update the annual burden hour estimate. On December 16, 2015, FMCSA published a final rule entitled “Electronic Logging Devices and Hours of Service Supporting Documents,” (80 FR 78292) that established minimum performance and design standards for hours-of-service (HOS) ELDs; requirements for the mandatory use of these devices by drivers currently required to prepare HOS records of duty status (RODS); requirements concerning HOS supporting documents; and measures to address concerns about harassment resulting from the mandatory use of ELDs. To ensure consistency among ELD vendors and devices, detailed functional specifications were published as part of the December 2015 final rule. Each ELD vendor developing an ELD technology must register online at a secure FMCSA website where the ELD provider can securely certify that its ELD is compliant with the functional specifications. Each ELD vendor must certify that each ELD model and version has been sufficiently tested to meet the functional requirements in the rule under the conditions in which the ELD would be used. A motor carrier required to use an ELD must use only an ELD that is listed on FMCSA’s registered ELD list, accessible through the Agency’s Web site in accordance with 49 CFR 395.22. ELD providers are required to self-certify and register their devices with FMCSA online via an application Form MCSA-5893, “Electronic Logging Device (ELD) Vendor Registration and Certification.” Once completed, FMCSA will issue a unique identification number that the provider will embed in their device(s). The collection is mandatory reporting, where the ELD providers are expected report four times a year and will register an average of 2 devices. FMCSA maintains a list on their website of the current ELD vendors and devices that have been certified (by the vendors) to meet the technical specifications. The information is necessary for fleets and drivers to easily find a compliant ELD for their use in meeting the FMCSA regulation requiring the use of ELDs. The estimated annual burden for this ICR is 150 hours. FMCSA’s re-estimate of the number of respondents and responses has resulted in a program adjustment decrease of an estimated annual 149 respondents, 744 responses, and 186 burden hours.

Abstract

This ICR estimates the burden commercial motor vehicle (CMV) drivers and motor carriers incur to comply with the mandatory reporting and recordkeeping tasks required for motor carriers to maintain driver qualification (DQ) files. FMCSA’s authority to require carriers to maintain DQ files is in 49 U.S.C. 504, 31133, 31136, and 31502; 49 CFR 391.51; and 49 CFR 1.87. A motor carrier is required to maintain specified information in a DQ file for each CMV driver it employs. The purpose of the information is to document the driver’s qualifications to operate a CMV. DQ files assist the motor carrier in assessing the safety risk of hiring an individual to drive a CMV. The DQ file documents that a driver: (1) is physically qualified to operate a CMV, (2) has the experience and training to safely operate the type of CMV he or she is assigned to drive, (3) has the appropriate driver’s license, (4) has not been disqualified from operating a CMV, and (5) has a history of avoiding high-risk behavior. The annual burden associated with this information collection consists of the Driver Hiring Process (IC-1), the Annual Review of Driver Qualifications (IC-2), the Limited Exemptions from Driver Qualification Documentation (IC-3), and the Driver Review and Rebuttal of Safety Performance History (IC-4). The DQ file assists Federal and State safety investigators in determining that motor carriers are weighing these factors in deciding who may drive CMVs on their behalf. Motor carriers collect and maintain part 391 information, and FMCSA does not require that information to be submitted to the Agency. A motor carrier must make the part 391 information available when an FMCSA or State investigator conducts an on-site review at the motor carrier’s place of business or terminal. The ICR is a revision due to the final rule titled Record of Violations and for the renewal of the ICR due to updated information relating to the driver population, turnover rates, and wage rate. FMCSA proposes to eliminate the requirement that drivers operating commercial motor vehicles (CMVs) in interstate commerce prepare and submit a list of their convictions for traffic violations to their employers annually. This requirement is largely duplicative of a separate provision that requires each motor carrier to make an annual inquiry to obtain the motor vehicle record (MVR) for each driver it employs from every State in which the driver holds or has held a CMV operator’s license or permit in the past year. To ensure motor carriers are aware of traffic violations for a driver who is licensed by a foreign authority rather than by a State, that provision would be amended to provide that motor carriers must make an annual inquiry to each driver’s licensing authority where a driver holds or has held a CMV operator’s license or permit. This change would require motor carriers to request the MVR equivalent from Canadian and Mexican driver’s licensing authorities. FMCSA expects that removing the requirement for drivers to provide a list of their convictions for traffic violations to their employers annually would reduce the paperwork burden on drivers and motor carriers without adversely affecting CMV safety. IC-2.1, “Driver submits list of violations” and IC-2.2, “Motor carrier files list of violations in DQ file” are removed from the ICR in this revision, and the driver population has been updated.

Why They Are Important

ICRs play a vital role in ensuring transparency and accountability in federal data collection. When federal agencies collect information from 10 or more "persons" (which includes individuals, businesses, and state, local, and tribal governments), they must submit an ICR to ensure that it fulfills their statutory missions, avoids unnecessary or duplicative requests, and minimizes burden on the American public. Additionally, Federal Register Notices (FRNs) and the opportunity for public comments provide a formal way for the public to be informed of proposed ICRs and participate in the process.

ICRs also serve as a key resource for tracking changes to federal data collections. The availability of detailed documentation, such as data collection instruments and methodologies, allows the general public to identify revisions in a timely manner. These may include revisions prompted by Executive Orders or statistical policies like OMB's Statistical Policy Directive No. 15 (SPD 15), which are often submitted as "nonsubstantive" or "nonmaterial" changes to a currently approved collection.[1] Furthermore, ICRs can help determine if a data collection has expired without renewal or has been intentionally discontinued. By reviewing ICRs, the public can better understand what data is being collected, how it evolves over time, and whether data collections have become inactive–often in response to shifting priorities and updated standards.

How To Use The Tool

The ICR tracking tool offers a user-friendly view of ICRs that have been recently submitted, reviewed, or are nearing expiration. By aggregating key data from individual ICRs, the tool allows users to view the current status of each request, including submission, conclusion, and expiration dates, details on whether any changes were made, authorizing statutes, and more. Users can search for specific information and filter results based on various criteria.
