Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Railroad Operating Rules

Key Information

Abstract

The collection of information associated with CFR parts 217 and 218, Railroad Operating Rules and Practices, requires railroads to file with FRA copies of their operating rules, timetables, timetable special instructions, and subsequent amendments. The regulations also require railroads to retain copies of these documents at their systems headquarters and make these documents available to FRA upon request. FRA is requiring the installation of inward and outward-facing locomotive image recording devices on all lead locomotives in passenger trains, as required by the Fixing America's Surface Transportation Act (FAST Act). In general, this final rule requires that these devices record while a lead locomotive is in motion and retain the data in a crashworthy memory module. This collection of information involves both reporting and recordkeeping requirements. The collection frequency of the required information occurs on an occasional basis as well as annually.

Fatigue Risk Management Programs for Certain Passenger and Freight Railroads

Key Information

Abstract

49 CFR part 270—System Safety Program (SSP) and part 271—Risk Reduction Program (RRP) require railroads subject to those rules to include a fatigue risk management program (FRMP) as one part of their railroad safety risk reduction programs. A railroad must adopt and implement its FRMP through an FRMP plan that the railroad has submitted to FRA for review and approval. These FRMP requirements are found at part 270, subpart E—Fatigue Risk Management Programs and at part 271, subpart G—Fatigue Risk Management Programs. FRA will use the information collected to ensure that railroads are developing and implementing an FRMP that meets regulatory requirements. FRA will also use the collected information to determine whether a railroad’s FRMP is improving railroad safety through the reduction of fatigue experienced by its safety-related railroad employees. This information collection is mandatory, submitted as needed, and there is a requirement for reporting.

Abstract

The registration and fingerprinting requirements currently appear in sections 1301-1306 of Title 8 of the United States Code. With limited exceptions, aliens above the age of 14 who remain in the United States for 30 days or longer, must apply for registration and be fingerprinted before the expiration of the 30 days, unless previously registered and fingerprinted under other provisions of immigration law. 8 U.S.C. 1302. Similarly, parents and guardians must ensure that their children below the age of 14 are registered. 8 U.S.C. 1302(b). Within 30 days of reaching his or her 14th birthday, the alien child must “apply in person for registration and to be fingerprinted.” 8 U.S.C. 1302(b). Implementing regulations can be found at 8 C.F.R. part 264. The Market Risk Regulatory Report for Institutions Subject to the Market Risk Capital Rule (FFIEC 102) is filed quarterly by FDIC-supervised banks and savings associations that are subject to the market risk capital rule. A bank, savings association, bank holding company, savings and loan holding company, or U.S. intermediate holding company must apply the market risk capital rule if the institution has aggregate trading assets and trading liabilities, as reported in the institution’s most recent Consolidated Reports of Condition and Income (Call Report) or Consolidated Financial Statements for Holding Companies (FR Y-9C), as applicable, equal to (a) 10 percent or more of quarter-end total assets or (b) $1 billion or more. The data collected in the Market Risk Regulatory Report is needed to assess the reasonableness and accuracy of a market risk institution’s calculation of its minimum capital requirements under the revised market risk capital rule and to evaluate a market risk institution’s capital in relation to its risks. Each market risk institution is required to file the FFIEC 102. The FFIEC 102 allows the agencies to better track growth in the more credit-risk related, less liquid, and less actively traded products subject to the market risk rule.

2026 Current Population Survey- Child Support Supplement

Key Information

Abstract

The Current Population Survey-Child Support Supplement (CPS-CSS, Child Support Supplement, (CSS) or Supplement) information collection helps the Office of Child Support Enforcement (OCSE) understand the child support landscape and effectiveness of the child support program and helps to inform policy decisions. The CPS-CSS, last conducted in 2023, was added to the CPS in 2006 as part of a data collection series that the federal government started in 1979 in response to a recommendation by the Conference on Issues in Federal Statistical Needs Relating to Women. As in prior years, the Census Bureau, through an interagency agreement with OCSE, collects the information on child support as a supplement to the monthly CPS. The next survey will take place in April 2026. The information collection activities associated with the CPS-CSS are authorized by 13 U.S.C. 182, which allows the Secretary of Commerce to conduct surveys necessary to furnish annual and other interim current data on the subjects covered by the census, and Title IV-D of the Social Security Act, which authorizes OCSE to sponsor the CPS-CSS. This request is for a revision of a currently approved information collection. Revisions were made to the CPS-CSS, as described in Attachment A, and to the burden estimates based on the last round of data collection.

Abstract

Due to Congress authorizing VA to require a prospective fiduciary to obtain a surety bond as a part of the certification process of a prospective fiduciary, VA is requiring fiduciaries to submit proof of adequate bonding with annual accounting to facilitate its oversight responsibility as mandated. RIN 2900-AR11, Fiduciary Bond, does not use a form to collect this information. However, the amended information request is made by VA field fiduciary personnel. They make the request either verbally or by letter that informs the fiduciary to submit the original bond certificate or the contractual agreement between the fiduciary and the bonding company as proof of adequate bonding. This amended collection of information is required to fulfill VA requirements mandated by Congress, for oversight of fiduciaries. The VA Fiduciary Program would not be able to provide adequate oversight of certain fiduciaries appointed to receive VA benefits in excess of $25,000 on behalf of a beneficiary without proof that surety bonds are in place to protect these funds.

Inpatient Psychiatric Facility Quality Reporting Program (CMS-10432)

Key Information

Abstract

Pursuant to section 1886(s)(4)(C) of the Social Security Act as added and amended by sections 3401 and 10322 of the Patient Protection and Affordable Care Act (ACA) and further amended by section 4125(c) of the Consolidated Appropriations Act, 2023, starting in FY 2014 (that is, October 1, 2013 through September 30, 2014) and for subsequent fiscal years, IPFs paid under the IPF PPS shall submit pre-defined quality measures to the CMS. Such data shall be submitted in a form and manner, and at a time specified by the Secretary. Section 1886(s)(4)(A) of the Act provides that IPFs that fail to submit data on the selected quality measures and comply with other administrative requirements will have their IPF prospective payment system (PPS) payment updates reduced by 2.0 percentage points. This is a revision of the currently approved information collection request. The Centers for Medicare & Medicaid Services’ (CMS’) quality reporting programs promote higher quality, more efficient healthcare for Medicare beneficiaries by collecting and reporting on quality-of-care metrics. This information is made available to consumers, both to empower Medicare beneficiaries and inform decision-making, as well as to incentivize healthcare facilities to make continued improvements. Specifically, CMS has implemented quality measure reporting programs for multiple settings, including for the Inpatient Psychiatric Facility (IPF) setting, to achieve its overarching priorities and initiatives, including the National Quality Strategy and the Meaningful Measure 2.0 Framework. In particular, Meaningful Measures 2.0 promotes innovation and modernization of all aspects of quality to better address health care priorities and gaps, emphasize digital quality measurement, and promote patient perspectives by supporting five interrelated goals: (1) empower consumers to make good health care choices through patient-directed quality measures and public transparency, (2) leverage quality measures to promote health equity and close gaps in care, (3) streamline quality measurement, (4) leverage measures to drive outcome improvement through public reporting and payment programs, and (5) improve quality measure efficiency by transitioning to digital measures and using advanced data analytics. The information collection requirements for the FY 2014 through FY 2028 program years (that is, data submitted from CY 2013 through CY 2027) are currently approved under OMB control number 0938-1171 (expiration date January 31, 2027). The PBGC needs the information required to be submitted to ensure that a voluntary termination if completed in accordance with statutory and regulatory requirements and to facilitate the payment of benefits to missing participants. Participants need the information required to be disclosed so that they will be informed about the status of the proposed termination of their plan and about their benefits upon termination.

Abstract

The market risk rule, which requires banking organizations to hold capital to cover their exposure to market risk, is an important component of the regulatory capital rules that have been adopted by the Board, Federal Deposit Insurance Corporation (FDIC), and Office of the Comptroller of the Currency (OCC) (collectively, the agencies). In order to implement the market risk rule, the agencies, acting under the auspices of the FFIEC, implemented the FFIEC 102, which collects key information from respondents on how they measure and calculate market risk under the regulatory capital rules. The Board’s market risk rule applies to state member banks (SMBs), bank holding companies (BHCs), covered savings and loan holding companies (covered SLHCs), and intermediate holding companies (IHCs) with aggregate reported trading assets and trading liabilities equal to or greater than 10 percent of quarter-end total assets or $1 billion (collectively, Board-regulated respondents). Board-regulated respondents must file the FFIEC 102 quarterly with the Board.

Complaints Regarding Invention Promoters

Key Information

Abstract

Pursuant to the Inventors’ Rights Act of 1999, 35 U.S.C. 297, and implementing regulations at 37 CFR, Part 4, the United States Patent and Trademark Office (USPTO) is required to provide a form for the publication of complaints concerning invention promoters. Upon receipt of a complaint, the USPTO will forward it to the invention promoter for a response. The USPTO does not investigate these complaints or participate in any legal proceedings against invention promoters or invention promotion companies. Under the Inventors’ Rights Act, the USPTO is responsible only for publishing complaints and responses on the USPTO website, making them available to the public. A complaint submitted to the USPTO must be clearly marked, or otherwise identified, as a complaint. The complaint must include: (1) the name and address of the complainant; (2) the name and address of the invention promoter; (3) the name of the customer; (4) the invention promotion services offered or performed by the invention promoter; (5) the name of the mass media in which the invention promoter advertised such services; (6) an example of the relationship between the customer and the invention promoter; and (7) a signature of the complainant. Identifying information is necessary so that the USPTO can both forward the complaint to the invention promoters or invention promotion companies as well as notify the complainant that the complaint has been forwarded. Complainants should understand that the complaints will be forwarded to the invention promoter for response and that the complaint and response will be made available to the public as required by the Inventors’ Rights Act. If the USPTO does not receive a response from the invention promoter within 30 days, the complaint will be published without a response. Under this program, the USPTO does not accept complaints that request confidentiality. The USPTO may refer submitted complaints to the USPTO Office of Enrollment and Discipline, as appropriate. This information collection contains one form, PTO/2048A (Complaint Regarding Invention Promotion), which is used by the public to submit a complaint under this program. This form is available for download from the USPTO website. Use of this form is voluntary. Complainants may submit a complaint without the form as long as the complaint includes the necessary information and the submission is clearly marked as a complaint filed under the Inventors’ Rights Act. Invention promotion firms may use any format when responding to a submitted complaint; there is no associated USPTO form.
