What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Acid Rain Program under Title IV of the Clean Air Act Amendments (Renewal)

Key Information

Abstract

Congress established the program in title IV of the 1990 Clean Air Act (CAA) Amendments to address acid deposition by reducing emissions of sulfur dioxide (SO2) and nitrogen oxides (NOX). This renewal generally outlines programmatic aspects as established in the previous ICR with adjustments to reflect current labor costs and estimates of the numbers of respondents and transactions. To reduce SO2 emissions, the Acid Rain Program uses a cap-and-trade system applicable to most large fossil fuel-fired electricity generating units in the contiguous United States. Affected sources are required to hold one tradable allowance for each ton of SO2 emitted, and the total number of allowances issued is capped. In addition to affected sources, any person or entity may establish an account to buy and sell allowances. EPA is required to conduct an allowance auction each year to promote market liquidity and price transparency. To reduce NOX emissions, the Acid Rain Program applies NOX emission rate limits to a subset of affected units. Each such unit may either meet its standard emission rate limit, arrange to comply on a group basis under an averaging plan, or seek approval for an alternative emission limitation (AEL) based on demonstrated inability to meet its otherwise applicable standard limit. Affected units under the Acid Rain Program are required to monitor opacity and SO2, NOX, and carbon dioxide (CO2) emissions using continuous emission monitoring systems (CEMS) or alternative monitoring methods approved by the EPA Administrator. All affected units are also required to obtain and periodically renew permits that identify their plans for complying with the programs applicable SO2 and NOX requirements. As in previous Acid Rain Program ICRs, most of the topical discussions in this ICR renewal are organized around the main program elements established under different CAA sections: Allowance transfers (CAA section 403); Permits (CAA section 408); Emissions monitoring (CAA section 412); Auctions (CAA section 416); NOx permitting (CAA section 407).

Abstract

The National Emission Standards for Hazardous Air Pollutants (NESHAP) for Plating and Polishing Area Sources (40 CFR Part 63, Subpart WWWWWW) were proposed on March 14, 2008; promulgated on July 1, 2008; and most-recently amended on both September 19, 2011 and November 19, 2020.1 These regulations apply to both existing and new plating and polishing facilities that are an area source of hazardous air pollutant (HAP) emissions and that use one or more of the following metal HAP: cadmium, chromium, lead manganese, or nickel (hereafter referred to as the plating and polishing metal HAP). In general, all NESHAP standards require initial notifications, performance tests, and periodic reports by the owners/operators of the affected facilities. They are also required to maintain records of the occurrence and duration of any startup, shutdown, or malfunction in the operation of an affected facility, or any period during which the monitoring system is inoperative. These notifications, reports, and records are essential in determining compliance, and are required of all affected facilities subject to NESHAP. This information is being collected to assure compliance with 40 CFR Part 63, Subpart WWWWWW.

Abstract

The Resource Conservation and Recovery Act (RCRA) requires EPA to establish a national regulatory program to ensure that hazardous wastes are managed in a manner that is protective of human health and the environment. Under this program, EPA regulates newly generated hazardous wastes as well as hazardous remediation wastes (i.e., hazardous wastes managed during cleanup). Hazardous remediation waste management sites must comply with all parts of 40 CFR part 264 except subparts B, C, and D. In place of these requirements, they need to comply with performance standards based on the general requirement goals in these sections, which are codified at 40 CFR 264.1(j). Under 264.1(j), owners/operators of remediation waste management sites must develop and maintain procedures to prevent accidents. These procedures must address proper design, construction, maintenance, and operation of hazardous remediation waste management units at the site. In addition, owners/operators must develop and maintain a contingency and emergency plan to control accidents that occur. The plan must explain specifically how to treat, store, and dispose of the hazardous remediation waste in question, and must be implemented immediately whenever fire, explosion, or release of hazardous waste or hazardous waste constituents that could threaten human health or the environment. In addition, the Remedial Action Plan streamlines the permitting process for remediation waste management sites to allow cleanups to take place more quickly.

Abstract

This is a renewal request. Air carriers, operators that are members of the Civil Reserve Air Fleet (CRAF), or direct contractors to DoD supporting the President's initiatives are required to respond to this collection and in return receive the benefit of insurance. The FAA uses information submitted by applicants for chapter 443 insurance to identify the eligibility of parties to be insured, the amount of coverage required, and insurance premiums. The information is a voluntary submission but is necessary for an operator or air carrier to obtain FAA insurance coverage. The data is collected on an as-needed basis for each carrier requesting insurance. Unaccompanied Alien Children Assessments for Children and Sponsors

Abstract

The Office of Refugee Resettlement (ORR) Unaccompanied Alien Children (UAC) Bureau provides care and custody for unaccompanied alien children until they can be safely released to a sponsor, repatriated to their home country, or obtain lawful immigration status. ORR funds residential care provider facilities that provide temporary housing and other services to children in ORR custody. Generally, care provider facilities are State-licensed, except those located in states unwilling to consider them for licensure and temporary emergency or influx care facilities and must meet ORR requirements to ensure a high-level quality of care. In order to adequately provide for the safety and wellbeing of children in ORR care, ORR conducts assessments of the child upon admission and at routine intervals while in ORR custody. Concurrently, ORR must identify and assess the suitability of potential sponsors and household members to ensure safe and timely release of the child to vetted and adult, qualified to provide for the child’s physical and emotional wellbeing. ORR uses several instruments to carry out its responsibilities with respect to UAC. These instruments are used, for example, to evaluate the child’s physical and mental health status, capture important biographic data, determine risk of sexual abuse or victimization, and enable ORR to track high-level milestones in the child’s case up through release. ORR has also developed an instrument to identify and screen potential sponsors. The instruments in this proposed information collection allow ORR to document the findings of these assessments as required by the Homeland Security Act of 2002 (6 U.S.C. 279); the Trafficking Victims Protection Reauthorization Act of 2008 (8 U.S.C. 1232); the Foundational Rule, 45 C.F.R. Part 410; and the Prevention of Sexual Abuse Interim Final Rule, 45 C.F.R. Part 411. Forms transferred from the Services information collection (OMB # 0970-0553) were last approved by OMB on August 22, 2024 and expire on April 30, 2025. Once approved, the Assessments information collection will contain a total of 9 unique, revised forms.

The information collected in FERC Form No. 60 and FERC 61 enables better monitoring for cross-subsidization, and aids the Commission in carrying out its statutory responsibilities. The U.S. Department of Education's Rehabilitation Services Administration (RSA) requests clearance for new data collection activities to support the evaluation of the 84.421E Federal fiscal year (FFY) 2023 Disability Innovation Fund (DIF), Pathways to Partnerships Innovative Model Demonstration Project. The purpose of the DIF, as provided by the Consolidated Appropriations Act, 2022 (Pub. L. 117-103), is to support innovative activities aimed at increasing competitive integrated employment as defined in section 7 of the Rehabilitation Act of 1973 (Rehabilitation Act) (29 U.S.C. 705(5)) for children, youth, and other individuals with disabilities. The program aims to create systematic and seamless approaches to offering transition services to children with disabilities, ages 10-13 and youth with disabilities ages 14 to 24 through collaborations among State vocational rehabilitation (VR) agencies, State education agencies (SEAs), local education agencies (LEAs), Federally funded Centers for Independent Living (CILs), and other organizations offering services to this population. RSA is investing a total of $198,975,322 in grant funding to the 20 States through the FFY 2023 DIF. This request covers primary data collection activities for the National Evaluation of the Pathways to Partnerships Program. These activities include the following: o Surveys and interviews with program participants or their parent or guardian o Surveys with State VR, SEA, and CIL directors o Surveys and interviews with project staff o Collecting project administrative data (staff rosters, cost worksheets, and web analytics) from project directors In September 2023, RSA awarded five-year cooperative agreements for the 84.421E FFY 2023 DIF model demonstration projects. The awards provide 20 State VR agencies or SEAs with funding to implement Pathways to Partnerships model demonstration projects. The Pathways to Partnerships models vary across the 20 projects, but the projects' purpose is to create and implement systematic approaches to delivering transition services to children and youth with disabilities. The approaches must entail establishing close partnerships across key agencies to deliver these services in ways likely to improve the education and employment outcomes of children and youth with disabilities.

Abstract

This Paperwork Reduction Act (PRA) submission requests Office of Management and Budget (OMB) approval of a renewal of the information collection requirements pertaining to the Atlantic Sea Scallop Fishery Management Plan (FMP) under OMB Control No. 0648-0491. The National Marine Fisheries Service (NMFS) manages the Atlantic Sea Scallop fishery through regulations that limit catch of scallops, bycatch of certain other species, and fishing vessel activity. This fishery is only effectively managed and these regulations implemented through the use of information collected by NMFS to track fishing effort, catch, and the exchange of quota and trips through exchange by vessel owners. This information can only be collected through the reporting requirements included in this renewal.

Abstract

This request is for an extension of a currently approved information collection. NOAA’s Office for Coastal Management requests the extension of a currently approved information collection. NOAA has, or is given, authority under the Coastal Zone Management Act (CZMA), annual appropriations or other authorities, to issue funds to coastal states, localities or other recipients for planning, conservation, acquisition, protection, restoration, or construction projects. The required information enables NOAA to implement the Coastal and Estuarine Land Conservation Program (CZMA section 307A), under its current or future authorization, and facilitate the review of similar projects under different, but related, authorities, including the National Estuarine Research Reserve System (CZMA section 315) Land Acquisition and Construction program, the Coastal Zone Management Program’s low-cost acquisition and construction program (CZMA section 306A), the Fish and Wildlife Coordination Act, or other authorities. This collection covers the development of state coastal land conservation plans, and collection of information specifically needed for applying for and carrying out land acquisition, restoration and construction projects, such as: appraisals, property surveys and site plans, legal documentation such as deeds, easements and/or plats, and information needed for environmental compliance reviews. Such information is collected from project applicants or sub-recipients, which are typically state or local government agencies, but may also include nongovernmental or Tribal organizations. The information will be used in evaluating project proposals, reviewing the location and impact of proposed activities, documenting compliance with the National Environmental Policy Act and other applicable statutes, and conducting due diligence on market value, title encumbrances, property boundaries, proper recording of legal instruments. No changes are proposed to the collection.

Abstract

The National Oceanic and Atmospheric Administration’s (NOAA) National Marine Fisheries Service (NMFS or NOAA Fisheries) is requesting an extension of this standard collection of information. The requested information will include different components of operating costs/expenditures, earnings, employment, ownership, vessel characteristics, effort/gear descriptors, and demographic information for the various types of fishing vessels operating in the 16 U.S. commercial fisheries or groups of fisheries listed below. 1. West Coast Limited Entry Groundfish Fixed Gear Fishery 2. West Coast Open Access Groundfish, Non-tribal Salmon, Crab, and Shrimp Fisheries 3. American Samoa Pelagic Longline Fishery 4. Hawaii Pelagic Longline Fishery 5. Hawaii Small Boat Fishery 6. American Samoa Small Boat Fishery 7. Greater Atlantic Region Commercial Fisheries To make it easier for the public and other reviewers to focus on the responses for a specific fishery or set of fisheries and the associated information collection, we provide a separate set of 18 responses for each information collection. However, for responses that apply to the bundled information collection request as a whole, we present the full response for only the first information collection, indicate the response applies to all 16 collections and then only reference that response in the corresponding response for the other 15 collections, unless the response is very brief. The responses for the 16 information collections are very similar to those in the Supporting Statement Part A, which OMB reviewed and approved 04/27/2022. However, NMFS updated the name of one collection to be consistent with Executive Order 14172, revised the sex/gender and race/ethnicity questions to be consistent with current OMB guidance, updated the data used to estimate the hourly wage rates, which are used in calculating annual wage burden costs, and updated the government cost estimates. In addition, due to uncertainty concerning the timing of funding to support each collection and exogenous shocks (e.g., the COVID-19 pandemic), which affect the feasibility and/or desirability of collecting data for a specific year, the schedule for each of the 16 information collections needs to be flexible. Therefore, NMFS no longer provides the exact year for each collection and the resulting reports it will support.

This information collection request (ICR) supports the Temporary Final Rule (TFR), Exercise of Time-Limited Authority to Increase the Numerical Limitation for Fiscal Year 2025 for H-2B Temporary Nonagricultural Worker Program and Portability Flexibility for H-2B Workers Seeking To Change Employers, which is being promulgated by the Department of Labor (DOL or Department) and the Department of Homeland Security (DHS) (collectively, the Departments). The regulatory requirements will be codified at 8 CFR part 214 and 20 CFR part 655. Abstract

The National Park Service (NPS) Social Science Program is authorized by the National Park Service Protection, Interpretation, and Research in System (54 U.S.C. 100701) to collect information that will improve the ability of the NPS to provide effective management, protection, and interpretation across the Service. However, data is needed to generalize findings across all national park units in the System with regards to visitor experiences, attitudes, and spending behaviors. Current data does not allow for comparison across units or against a regional and nationwide benchmark of information. The proposed collection will provide generalizable results for NPS managers and planners across the System to understand and monitor visitor demographics, economic contribution, services, facilities, and infrastructure investments. Park units will be able to compare their unit data with regional and national-level data to make informed decisions in future planning and management efforts. In support of these goals, and in alignment with the Explore Act (Public Law 118–234), this effort will also advance national objectives to expand and improve outdoor recreation opportunities through enhanced data on use, access, and public engagement.

Key Information

Abstract

The Social Security Act establishes travel expense reimbursement by Federal and state agencies for claimants travel incidental to medical examinations and to parties, their representatives, and all reasonably necessary witnesses for travel exceeding 75 miles to attend medical examinations, reconsideration interviews and proceedings before an administrative law judge. Reimbursement procedures require the claimant to provide 1) a list of expenses incurred, and 2) receipts of such expense. State and Federal personnel review the listings and receipts to verify the amount to be reimbursed to the claimant. The respondents are claimants for Title II benefits and Title XVI payments, their representatives and witnesses.
