Change Requests
What is an ICR?
An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public.
Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.
When are they submitted?
Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection,
supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.
The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after
which the collection must be renewed through a new ICR submission.

The U.S. Environmental Protection Agency (EPA) makes competitive financial assistance awards to support projects that tackle environmental, public health, and energy challenges across the country. This is accomplished by working directly with community-based organizations (CBOs) and state, local, territorial, and tribal governments that have strong ties to the communities in which they are working. EPA fosters a collaborative approach to tackling some of the most critical challenges in the most overburdened communities by encouraging projects that involve multiple stakeholders including States, local governments, and tribal governments. To help get resources and funding to underserved and overburdened communities EPA offers Environmental Justice Collaborative Problem Solving (EJCPS) and Environmental Justice Government to Government (EJG2G) cooperative agreement programs. With this Information Collection Request (ICR), EPA seeks authorization to collect post-award information in the form of semi-annual progress reports and final reports from each grantee to track their progress, with respect to effectiveness (e.g., the extent to which projects achieved their objectives, goals, and targets), efficiency (e.g., the extent to which projects delivered activities and outputs on schedule and within budget), and equity (e.g., the extent to which investments and benefits flowed to disadvantaged communities that are marginalized, underserved, and overburdened by pollution). Collection of this information enables EPA to assess and manage the EJCPS and EJG2G programs, which ensures responsible stewardship of public funds; rigorous evidence-based learning and improvement; and transparent accountability to the American public. |

Abstract
This ICR covers the information collection activities associated with the pesticide container design and residue removal requirements and containment structure requirements. With respect to the container design and residue removal requirements, the information collection activities are associated with the requirement that businesses subject to the container regulations (pesticide registrants) and repackaging regulations (pesticide registrants and refillers) maintain records of test data, cleaning procedures, certain data when a container is refilled, and other supporting information. These records are subject to both call-in by EPA and on-site inspection by EPA and its representatives. EPA has not established a regular schedule for the collection of these records, and there is no reporting. With respect to the containment structure requirements, the information collection activities are associated with the requirement that businesses subject to the containment structure regulations maintain records of the: (1) Monthly inspection and maintenance of each containment structure and all stationary bulk containers; (2) Duration over which non-stationary bulk containers holding pesticide and not protected by a secondary containment unit remain at the same location; and (3) Construction date of the containment structure. The businesses subject to the containment structure regulations include agrichemical retailers and refilling establishments, custom blenders and commercial applicators of agricultural pesticides. The records have to be maintained by the owners and operators of such businesses and made available to inspectors to ensure that businesses are in compliance with containment requirements. These inspections are generally conducted by the states, which enforce FIFRA regulations through cooperative agreements with EPA. |

Abstract
This Information Collection Request (ICR) covers the paperwork burden hours and costs associated with the information collection activities under the pesticide registration fee programs implemented through the Office of Pesticide Programs (OPP), Environmental Protection Agency (EPA). Pesticide registrants are required by statute to pay an annual registration maintenance fee for all products registered under Section 3 and Section 24(c) of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). Additionally, Section 33 of FIFRA establishes statutory fees and timeframes for EPAs review of covered applications. PRIA 5 which was enacted December 2022, did many things including that it extended the authority to collect pesticide maintenance fees through FY2027 and the authority to collect pesticide registration service fees through FY2029.This ICR specifically covers the activities related to the collection of the annual registration maintenance fees, the registration service fees, and the burden associated with the submission of requests for fees to be waived. |

Abstract
Under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), the Environmental Protection Agency (EPA) regulates the importation of pesticides and pesticide devices into the United States. FIFRAs definition of pesticides is broad and includes any substance or mixture of substances intended for preventing, destroying, repelling, or mitigating any pest (e.g., rodenticides, insecticides, herbicides, fungicides, and antimicrobials) and certain other substances such as plant growth regulators and any nitrogen stabilizers; the definition also includes substances imported for pesticide research and development purposes. FIFRAs definition of pesticide devices include any instrument or contrivance (other than a firearm) which is intended for trapping, destroying, repelling, or mitigating any pest or any other form of plant or animal life. FIFRA section 17(c) governs the importation process for pesticides and pesticide devices into the U.S., while FIFRA 17(e) authorizes the U.S. Department of the Treasury, in consultation with the EPA, to promulgate regulations implementing pesticide and device trade enforcement. This authority was delegated to the Department of Homeland Security's U.S. Customs and Border Protection (CBP) in 2003. CBP regulations, developed in concert with the EPA, give the EPA specific roles in the importation process. |

The National Defense Authorization Act (NDAA) for Fiscal Year 2010 (Public Law 11184, enacted October 28, 2009) requires an expanded effort to recruit U.S. and other eligible workers for employment on Guam military base realignment construction projects. This reporting structure features electronic posting of construction job opportunities on an Internet job banks site with national coverage, posting job opportunities on several state workforce agency job banks, and documentation of worker recruitment results reports that will be submitted to the Guam Department of Labor (GDOL). All data collection and reporting will be done by military base construction contractors, and the data and recruitment results in a report that will be submitted to the GDOL. These recruitment requirements help fulfill the responsibilities assigned to the Secretary of Labor in the provisions of the NDAA of 2010 and increase employment opportunities for U.S. construction workers. |

The Alien Claimant Activity Report is the only source available for collecting this information. The report allows the Department to determine the number of aliens filing for unemployment insurance (UI), the number of benefit issues detected and the denials resulting from the USCIS SAVE system. The Office of Resource Conservation and Recovery (ORCR) Resource Conservation and Sustainability Division (RCSD) requires the ability to collect consistent and timely information from grant recipients receiving EPA funding originating from the Bipartisan Infrastructure Law, (also known as the Infrastructure Investment and Jobs Act (IIJA)). Additionally, in order to carry out the Agency’s obligations under Resource Conservation and Recovery Act (RCRA), RCSD needs broad-based national information on waste streams and materials management practices. This ICR covers two related information collections that are essential for RCSD to properly understand current conditions and promote interventions that can lead to a more sustainable future. One is based on the collection of progress and final reports from Solid Waste Infrastructure for Recycling (SWIFR) and Recycling Education and Outreach (REO) grant recipients. The reports provide the Agency with necessary administrative information, documentation of grant outputs and outcomes, and for many grantees, data on the volume of materials and types of waste management methods they employ. EPA plans to use a web-based data management system to facilitate the collection and processing of these reports from grantees. The second proposed information collection is a voluntary annual survey to gather detailed information from all U.S. states and territories about their existing waste management programs, capacities, and throughputs. Survey respondents will also be grant recipients and the same electronic data management system can be used to collect and process survey results. |

Abstract
This information collection request (ICR) addresses the reporting and recordkeeping requirements under section 8(b) of the Toxic Substance Control Act (TSCA) that are associated with the TSCA Chemical Substance Inventory (TSCA Inventory), as codified in 40 CFR Part 710. TSCA section 8(b) specifically requires that EPA compile and keep current a list of chemical substances manufactured or processed for commercial purposes in the United States. That mandate was amended in 2016 and TSCA section 8(b)(4) requires EPA to designate chemical substances on the TSCA Chemical Substance Inventory as either active or inactive in U.S. commerce. The first TSCA Inventory with all chemical substances designated as active or inactive published in February 2019. Starting August 5, 2019, manufacturers and processors are required to notify EPA before reintroducing inactive substances into U.S. commerce. The implementing regulations allow manufacturers and processors to notify EPA that it must change the commercial activity designation of the subject chemical substance from inactive to active on the TSCA Inventory. In March 2020, EPA amended 40 CFR part 710 to revise the requirements for companies to substantiate their confidential business information (CBI) claims for the specific chemical identities of substances on the TSCA inventory. The burden and activities in that amendment are covered by a rule related addendum to this ICR identified under OMB Control No. 2070-0210 (EPA ICR No. 2594.03). At this time, the information collection activities covered in the existing ICR related to the time-limited one time reporting (EPA Form No. 9600-05; Notice of Activity Form A), and the retrospective substantiation of CBI imposed by the 2020 amendment that is covered by the ICR addendum identified under OMB Control No. 2070-0210 (EPA ICR No. 2594.03) are now complete and are not included in this ICR. |
