What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

The Office of Ground Water and Drinking Water (OGWDW) in the Office of Water at the United States Environmental Protection Agency (EPA) is responsible for managing the Public Water System Supervision (PWSS) Program, a national program mandated by the Safe Drinking Water Act (SDWA). Section 1414 of the SDWA requires each community water system to mail, or provide by electronic means, to each customer of the system at least once annually a report on the level of contaminants in the drinking water purveyed by that system, known as the “consumer confidence report.” SDWA requires the EPA to monitor and enforce National Primary Drinking Water Regulations (NPDWRs) to ensure that the nation’s drinking water reliably complies with the maximum contaminant levels (MCLs), maximum residual disinfectant limits (MRDLs), treatment techniques (TT) and other requirements stipulated in the Code of Federal Regulations (CFR), 40 CFR Part 141, Subpart B. Section 1445 of the SDWA states that public water systems (PWS) shall conduct monitoring, maintain records, and provide information as needed for the EPA to implement its monitoring and enforcement responsibilities with respect to the Act. Primacy agencies, the EPA and state governments that have assumed primary enforcement responsibility under SDWA section 1413, ensure that PWSs are complying with these regulatory requirements. As part of the PWSS Program, OGWDW uses the Safe Drinking Water Information System (SDWIS) as the database of record for compliance with NPDWR requirements. SDWIS is a database management system that assists the EPA in tracking and interpreting violations data and other program-related data. This ICR provides burden and cost estimates for the final revised Consumer Confidence Report (CCR) rule, including compliance monitoring data (CMD) reporting by primacy agencies. The EPA is finalizing the revised CCR rule to require CWSs serving 10,000 or more people that have violations to include a six month update with their annual report. All other CWSs (without violations) serving 10,000 or more people will be required to reissue their annual report by December 31st. To implement its compliance oversight and enforcement responsibilities under the SDWA, the EPA is finalizing a provision as part of the rulemaking that will require primacy agencies to submit their CMD annually. The ICR estimates costs for future rule implementation.

Abstract

EPA is now proposing certain amendments to the e-Manifest regulations for shipments of hazardous waste that are exported for treatment, storage, and disposal. In addition, EPA proposes regulatory amendments to the three manifest-related, written reports, including: (1) Exception Report, (2) Discrepancy Report, and (3) Unmanifested Waste Report, which address specific issues that arise in the use of the manifest. Because much of the manifest information that is the basis for these separate reports will be available in e-Manifest, EPA is proposing regulatory changes so that these reports can be transmitted electronically and more efficiently in the e Manifest system rather than as separate, written reports. Further, EPA proposes conforming regulatory changes to the Toxic Substances Control Act (TSCA) manifest regulations for polychlorinated biphenyls (PCB) wastes. PCB wastes are not hazardous wastes pursuant to RCRA but are required under TSCA regulations to be tracked under a RCRA hazardous waste manifest when transported from the site of generation to an off-site facility for commercial storage or disposal. Proposed changes to the TSCA manifest regulations are necessary to align with the RCRA manifest regulations and the e-Manifest Program. EPA also proposes regulatory changes to the RCRA hazardous waste export and import shipment international movement document related requirements to more closely link the manifest data with the international movement document data. Finally, the Agency proposes to make technical corrections to fix typographical errors in the e-Manifest and movement document regulations.

Abstract

This request is for a revision and extension. The revision consists of updating the demographic questions to adhere to the new OMB approved demographic questions under the Statistical Policy Directive on 3/29/24 and updating sample sizes and burden hours based on recent fishing license data. Marine recreational fishing is a popular pastime across the United States (U.S.) that generates economic activity and benefits to local communities, state economies, and to the nation. The National Marine Fisheries Service (NMFS) is required to provide economic data and analysis on recreational fishing for use in fisheries management. The purpose of this data collection is to gather information on marine recreational anglers’ expenditures on fishing trips and durable goods related to fishing. These data are used in fisheries management analyses by state fisheries agencies, regional fishery management councils, and NMFS to understand the economic effects of fisheries regulations and policies. The survey will target marine recreational anglers in all coastal states. As the survey is conducted across all coastal states and specifically targets marine recreational fishing, the benefits are that it can provide comparable data across states and at a national level and is easily available to federal and state agencies who need timely economic information on marine recreational fishing. Results of the survey are also used in NMFS economic reports, by other NOAA and Department of Commerce offices, by academic researchers, and a wide variety of other groups and constituents interested in marine recreational fisheries.

Abstract

This is a request for renewal of an approved information collection. Under the Magnuson-Stevens Fishery Conservation and Management Act, the Secretary of Commerce has the responsibility for the conservation and management of marine fishery resources. Much of this responsibility has been delegated to the NOAA’s National Marine Fisheries Service (NMFS). Under this stewardship role, the Secretary was given certain regulatory authorities to ensure the most beneficial uses of these resources. One of the regulatory steps taken to care out the conservation and management objectives is to collect information from users of the resources. This collection requires limited access mackerel and longfin squid/butterfish moratorium permit holders to bring all catch aboard the vessel and make it available for sampling by an observer. If a catch is not made available to an observer before discard, that catch is defined as slippage, and the vessel operator must complete a “Released Catch Affidavit” form within 48 hours of the end of the fishing trip which details why catch was slipped, estimates the quantity and species composition of the slipped catch, and records the time and location of the slipped catch. This collection also requires any vessel with a limited access mackerel permit intending to land over 20,000 lb of mackerel to contact NMFS at least 48 hours in advance of a fishing trip to request an observer. Vessels currently contact NMFS via phone, and selection notices or waivers are issued by NMFS via VMS. If service providers are unable to provide coverage, an owner, operator, or vessel manager may request a waiver by calling the Northeast Fisheries Observer Program. Additionally, if a fishing trip is cancelled, vessels must notify NMFS of the cancelled trip to prevent observers from being deployed to a cancelled trip.

Abstract

The FAA’s DroneZone platform (https://dronezone.faa.gov) is the public-facing online hub for UAS activities and information reporting, including safety event reporting. The FAA is continually updating DroneZone to add functionality and improve users’ registration experience. The Safety Event Reporting information collected by the FAA through the DroneZone website, Flight Standards District Offices, one of the Regional Operations Centers, or the Washington Operations Center for each sUAS safety event is used to investigate and determine regulatory compliance. In addition, the safety event information goes into the FAA aircraft accident database for safety analysis purposes by the FAA Office of Accident Investigation and Analysis, pursuant to its statutory safety mission. As is currently the case for manned aircraft accidents, sUAS safety event data will be made available to the public and the National Transportation Safety Board (NTSB). Submission of accident information is mandatory if a small unmanned aircraft safety event meets certain criteria. The affected population consists of small unmanned aircraft operators.

Abstract

This is a request for revision and extension of an approved information collection. Section 315 of the National Marine Sanctuaries Act (NMSA) (16 U.S.C. § 1445a) allows the Secretary of Commerce to establish one or more advisory councils to advise and make recommendations to the Secretary regarding the designation and management of national marine sanctuaries. Executive Order 13178 (December 4, 2000) similarly established a Coral Reef Ecosystem Reserve Council pursuant to the NMSA for the Northwestern Hawaiian Islands Coral Reef Ecosystem Reserve. Councils are individually chartered for each site, or for the sanctuary system, to meet its specific needs. Once an advisory council has been chartered, a sanctuary superintendent starts a process to recruit members for that council by providing notice to the public and requesting interested parties to apply for the available seat(s) (e.g., Research, Education) and position(s) (i.e., council member or alternate). The information obtained through this application process will be used to determine the qualifications of the applicant for membership on the advisory council. Two application forms are currently associated with this information collection: (a) National Marine Sanctuary Advisory Council Application form; and (b) National Marine Sanctuary Advisory Council Youth Seat Application form. Application form instructions will specify requirements imposed upon the agency when reviewing applicants as potential council members or alternates. Questions posed to applicants have been reviewed and an additional two questions are being added to solicit information on eligibility for a potential stipend program to decrease financial barriers to joining advisory councils. An additional section for demographic questions is also being added to include the newly updated Statistical Policy Directive No. 15: Standards for Maintaining, Collecting, and Presenting Federal Data on Race and Ethnicity and Recommendations on the Best Practices for the Collection of Sexual Orientation and Gender Identity Data on Federal Statistical Surveys, and to learn more about our applicants. Existing questions may be reordered, reworded, and at times, condensed to improve the organization of applicant responses and, thereby, simplify the applicant review process. We do not believe that such revisions to the application would appreciably change the average annual number of respondents or the reporting burden for the information requirements supporting solicitation of new advisory council members.

Abstract

The State Annual Long-Term Care Ombudsman Report is needed to comply with Administration for Community Living/Administration on Aging (ACL/AoA) reporting requirements in the Older Americans Act (OAA); and 45 CFR §1324.21(b) (1) and (b)(2)(v). The long-term care ombudsman report is used to measure the services and strategies that are provided to assist residents in the protection of their health, safety, welfare or rights; advocate at the state and federal levels for changes needed to improve the quality of life and care in long-term care facilities; and effectively manage the Long-Term Care Ombudsman Program at the state and federal level. The National Ombudsman Reporting System (NORS) was developed in response to these needs and directives. Section 712(c) of the OAA requires the state agency to establish a statewide uniform reporting system to: (1) Collect and analyze data relating to resident complaints and conditions in long-term care facilities for the purpose of identifying and resolving significant problems. and (2) Submit the data on a regular basis to the state licensing/certifying agency, other state and federal entities that the Ombudsman determines to be appropriate, the Assistant Secretary for Aging, and the National Long-Term Care Ombudsman Resource Center.

Abstract

The Clean Watersheds Needs Survey (CWNS) is required by Clean Water Act (CWA) Sections 205(a) and 516. It is a periodic inventory of existing and planned publicly owned wastewater conveyance and treatment facilities, combined sewer overflow correction, stormwater management and other water pollution control facilities in the United States, as well as an estimate of how many of these facilities need to be built. The CWNS is a joint effort between EPA and the states. The CWNS collects cost and technical data from states that are associated with publicly owned treatment works and other water pollution control facilities, existing and planned. The respondents who provide this information to Environmental Protection Agency (EPA or Agency) are state agencies responsible for environmental pollution control and local facility contacts who provide documentation to the states. Periodically, the states request data or documentation from contacts at the facility or local government level. These respondents are referred to as facilities. No confidential information is used, nor is sensitive information protected from release under the Public Information Act. EPA achieves national consistency in the final results through the application of uniform guidelines and validation techniques.

Abstract

Clean Water Act section 312(p), titled Uniform National Standards for Discharges Incidental to Normal Operation of Vessels, directs EPA to establish national standards of performance for discharges incidental to the normal operation of commercial vessels greater than 79 feet in length; other non-recreational, non-Armed Forces vessels, such as research and emergency rescue vessels; and ballast water only from small vessels (vessels less than 79 feet in length) and fishing vessels of all sizes. The activities covered by this ICR include petitions from states, as provided for in 312(p), for the establishment of no-discharge zones (NDZs), issuance of emergency orders, review of standards of performance, and establishment of enhanced Great Lakes system requirements. This is not a reporting requirement, nor are there any deadlines associated with these requests. Instead, states may voluntary undertake the burden of pursuing a petition as needed or desired. The information collection burden is largely attributable to the preparation of these petitions by states and EPA's subsequent review of the petitions.

This request is for revision and extension of a currently approved information collection by the Office of National Marine Sanctuaries (ONMS). ONMS manages national marine sanctuaries pursuant to the purposes and policies of the National Marine Sanctuaries Act (16 U.S.C. 1431 et seq.). National marine sanctuary regulations at 15 CFR part 922 list specific activities that are prohibited in national marine sanctuaries. These regulations also state that otherwise prohibited activities may be conducted if a permit is issued by ONMS. Persons desiring a permit must submit an application (note that requests for baitfish permits and Tortugas Ecological Reserve North Access permits require contacting Florida Keys National Marine Sanctuary and do not require a completed ONMS permit application), and anyone obtaining a permit is generally required to submit one or more reports on the activity allowed under the permit. The recordkeeping and reporting requirements at 15 CFR part 922 form the basis for this collection of information. This information is required by ONMS to protect and manage sanctuary resources. The permit application collects information about the proposed activities, the methods proposed to be used, the potential effects to sanctuary resources, and information on the regulatory review criteria at 15 CFR part 922. ONMS uses this information to evaluate whether the proposed activities are consistent with the goals and objectives of the sanctuary and the purposes and policies of the NMSA. Changes to this information collection include revisions to the permit application and instructions to collect information about small businesses to better assess the types of entities engaged in permitting activities. The estimated number of permits issued per year also changed from 424 to 567 to reflect the additional estimated permit numbers if the various proposed national marine sanctuary designations are finalized. In particular, this is based on adding an estimated fifteen additional permits and about 59 certifications for the proposed Chumash Heritage National Marine Sanctuary (88 FR 58123, August 25, 2023), an estimated five additional permits for the proposed designation of the National Marine Sanctuary for the Pacific Remote Islands (88 FR 23624; April 18, 2023), an estimated five additional permits for proposed Lake Ontario National Marine Sanctuary (88 FR 3334, January 19, 2023), an estimated five additional permits for proposed Lake Erie Quadrangle National Marine Sanctuary (88 FR 32198, July 18, 2023), an estimated nine permits for the proposed sanctuary in the Hudson Canyon area (87 FR 38387, June 8, 2022), and increasing the numbers of amendments and Tortugas access permits to reflect more recent average permit numbers. The number of baitfish permits was diminished by 35 permits and Florida Keys National Marine Sanctuary plans to phase out the bait fishing permits over the next three years (87 FR 42800, July 18, 2022).

Abstract

This request is for the extension of a current information collection. The evaluation of visitor demographics, experiences, and opinions about visitor centers and exhibits is needed to support the conservation, education, and management goals of the National Oceanic and Atmospheric Administration Office of National Marine Sanctuaries (ONMS) to strengthen and improve the stewardship, sustainable use, and protection of natural, cultural, and historical resources. Under the jurisdiction of ONMS and to satisfy legal mandates, the National Oceanic and Atmospheric Administration (NOAA) is authorized to conduct evaluations, such as this information collection, under the American Innovation and Competitiveness Act (Section 314(c), codified at 33 U.S.C. § 893(a)) to ensure education programs have measurable objectives and milestones, as well as clear, documented metrics for evaluating its programs. We therefore are seeking to find out if people visiting ONMS’ visitor centers and exhibits are receiving our new messages by conducting an optional exit survey. Conducting thorough evaluations will aid in vital decisions regarding exhibit renovation, new exhibits, interpretation programs, and educational content.

Abstract

The purpose of this information collection request (ICR), the ACL Consolidated Program Performance Report is to collect program performance data fort the Administration for Community Living (ACL) formula and competitive grant programs authorized by the Older Americans Act (OAA), as required by and in accordance with P.L. 116-131 and 42 USC Chapter 7, Subchapter XX, Division B (authorizing legislation); 45 CFR 75.342 (monitoring and reporting program performance); 45 CFR 75.301 (performance measurement); and the GPRA Modernization Act of 2010 (Pub.L. 111-352, Sec 12). ACL is primarily a grant-making agency whose mission is to maximize the independence, well-being, and health of older adults, people with disabilities across the lifespan, and their families and caregivers by supporting partnerships and providing funding, guidance, training, and technical assistance. The collection of program performance data is required for all ACL grantees, including grants authorized by the OAA, to: (1)Monitor achievement of program performance objectives; (2) Identify areas of performance that may benefit from technical assistance and/or corrective action; (3) Establish program policy and direction; and (4) Prepare responses and reports for Congress, the Office of Management and Budget (OMB), the public, and legislatively required reports.

Abstract

This request is for extension of a current information collection. This action would continue the reporting measure requiring all Virginia Chesapeake Bay pound net fishermen to report interactions with endangered and threatened sea turtles, found both live and dead, in their pound net operations. This reporting is required under Endangered Species Act (ESA) regulations, and is necessary to ensure sea turtles are being conserved and protected, as mandated by the ESA. When a live or dead sea turtle is discovered during a pound net trip, the Virginia pound net fisherman is required to report the incidental take to National Marine Fisheries Service (NMFS) and, if necessary, the appropriate rehabilitation and stranding network. This information will be used to monitor the level of incidental take in the state-managed Virginia pound net fishery and ensure that the seasonal pound net leader restrictions (50 CFR 223.206(d)(10)) are adequately protecting listed sea turtles. Based on the number of sea turtle takes anticipated in the Virginia pound net fishery and the available number of Virginia pound net fishermen and pound nets, the number of responses anticipated on an annual basis is 1,003.
