What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

This information collection request (ICR) applies to background checks for specified contractor employees working in sensitive locations or sensitive projects who are not otherwise covered by a background check in accordance with Homeland Security Presidential Directive-12 (HSPD-12). The EPA uses contractors to perform services throughout the nation with regard to environmental emergencies involving the release, or threatened release, of oil, radioactive materials or hazardous chemicals that may potentially affect communities and the surrounding environment. Releases may be accidental, deliberate, or may be caused by natural disasters. The information is collected for each employee who will be working at sensitive sites or in sensitive positions which could involve law enforcement activities, indoor cleanups (including occupied household residences), drug lab cleanups, and emergency response actions at geographically sensitive locations such as military installations and Government buildings.

The EPA is finalizing National Primary Drinking Water Regulations for six per- and polyfluoroalkyl substances (PFAS) including perfluorooctanoic acid (PFOA), perfluorooctane sulfonic acid (PFOS), perfluorohexane sulfonic acid (PFHxS), perfluorononanoic acid (PFNA), hexafluoropropylene oxide dimer acid (HFPO-DA, commonly known as GenX Chemicals), and perfluorobutane sulfonic acid (PFBS). The EPA is finalizing Maximum Contaminant Level Goals (MCLGs) for PFOA and PFOS at zero and the enforceable Maximum Contaminant Level (MCL) at 0.0000040 mg/L or 4.0 ppt for each of these contaminants. The EPA is also finalizing individual MCLGs and is promulgating individual MCLs for PFHxS, PFNA and HFPO-DA at 10 ppt. Lastly, the EPA is finalizing a Hazard Index (HI) of 1 (unitless) as the MCLG and MCL for any mixture containing two or more of PFHxS, PFNA, HFPO-DA and PFBS.

Abstract

This request is for extension of a current information collection. The Coastal Zone Management Act of 1972, 16 U.S.C. 1451–1465, provides for the designation of estuarine research reserves representative of various regions and estuarine types in the United States to provide opportunities for long-term research, education and interpretation. During the site selection and designation process, information is collected from states in order to prepare a management plan and environmental impact statement. Designated reserves apply annually for operations funds by submitting a work plan; subsequently progress reports are required every six months for the duration of the award. Each reserve compiles an ecological characterization or site profile to describe the biological and physical environment of the reserve, research to date and research gaps. Reserves revise their management plans every five years. A competitive fellowship program supports opportunities for graduate students to conduct research at each reserve. This information is required to ensure that reserves are adhering to regulations and that the reserves are in keeping with the purpose for which they were designated.

Abstract

As directed in the June 2016 Frank R. Lautenberg Chemical Safety for the 21st Century Act amendments to the Toxic Substances Control Act (TSCA), 15 U.S.C. 2601 et seq., EPA is required to assist in the preparation and publication in the Federal Register of an inventory of mercury supply, use, and trade in the United States. 15 U.S.C. 2607(b)(10)(B) and (D). Based on the inventory of information collected through this ICR, the Agency is directed to identify any manufacturing processes or products that intentionally add mercury and recommend actions, including proposed revisions of Federal law or regulations, to achieve further reductions in mercury use. 15 U.S.C. 2607(b)(10)(C). The primary purpose of this ICR is to support the development of that inventory. In turn, the inventory will help the Agency identify uses of mercury and recommend means to achieve further reductions of such uses in commerce. In addition, the Agency seeks to obtain the information necessary to achieve its goal to further reduce the use of mercury in products and certain manufacturing processes in order to prevent future releases to the environment, as well as assist the United States in reporting implementation under the Minamata Convention. EPA seeks to enhance its current information on how much mercury is used, in which products and manufacturing processes, and whether certain products are manufactured domestically, imported, or exported. Reporting is required from any person who manufactures (including imports) mercury or mercury-added products, as well as any person who otherwise intentionally uses mercury in a manufacturing process under TSCA section 8(b). The Agency promulgated reporting requirements at 40 CFR part 713. To avoid duplication, EPA coordinated the reporting with the Interstate Mercury Education and Reduction Clearinghouse (IMERC).

Abstract

This ICR amends the previously approved ICR (EPA ICR Number 1189.28), OMB Control No. 2050-0053, which covers the Identification, Listing and Rulemaking Petitions under the authority of the Resource Conservation and Recovery Act of 1976 (RCRA), as amended, codified under 40 Code of Federal Regulations (CFR) part 257. This ICR package (EPA ICR Number 2810.01) represents the new information collection requirements imposed by the proposed rule titled Hazardous and Solid Waste Management System: Disposal of Coal Combustion Residuals from Electric Utilities; Federal CCR Permit Program; Proposed Rule. The EPA published a final rule to regulate the disposal of coal combustion residuals (CCR) from electric utilities as solid waste under RCRA Subtitle D. See 80 Fed. Reg. 21302 (April 17, 2015). EPA established national minimum criteria for existing and new CCR landfills and CCR surface impoundments and all lateral expansions to include location restrictions, design and operating criteria, groundwater monitoring and corrective action, closure requirements and post-closure care, and recordkeeping, notification, and internet posting requirements. Since the final rule, several court decisions have required accelerated closure timelines for many units. The Part A Proposed Rule incorporates the results of the court decisions and establishes processes for units to receive closure extensions beyond the court-mandated deadlines. In December 2016, Congress passed, and the President signed the Water Infrastructure Improvements for the Nation (WIIN) Act, amending section 4005 of the Resource Conservation and Recovery Act (RCRA). The WIIN Act, among other things, requires the Environmental Protection Agency (EPA or the Agency) to implement a federal coal combustion residuals (CCR) permit program in Indian country and, subject to the availability of appropriations specifically provided to carry out a program, to implement a federal CCR permit program in nonparticipating states. The Fiscal Year 2018 and 2019 Omnibus Appropriations Acts provided appropriations to EPA to develop and implement a federal permit program for the regulation of CCR in nonparticipating states. In the action this ICR accompanies, the Agency is proposing to establish a federal CCR permit program in accordance with the requirements of the WIIN Act.

Abstract

10 CFR part 54 establishes license renewal requirements for commercial nuclear power plants and describes the information that licensees must submit to the NRC when applying for a license renewal. The application must contain information on how the licensee will manage the detrimental effects of age-related degradation on certain plant systems, structures, and components to continue the plant’s safe operation during the renewal term. The NRC needs this information to determine whether the licensee’s actions will be effective in assuring the plants’ continued safe operation during the period of extended operation. Holders of renewed licenses must retain in an auditable and retrievable form, for the term of the renewed operating license, all information and documentation required to document compliance with 10 CFR part 54. Abstract

The Office of Ground Water and Drinking Water (OGWDW) in the Office of Water at the United States Environmental Protection Agency (EPA) is responsible for managing the Public Water System Supervision (PWSS) Program, a national program mandated by the Safe Drinking Water Act (SDWA). Section 1414 of the SDWA requires each community water system to mail, or provide by electronic means, to each customer of the system at least once annually a report on the level of contaminants in the drinking water purveyed by that system, known as the “consumer confidence report.” SDWA requires the EPA to monitor and enforce National Primary Drinking Water Regulations (NPDWRs) to ensure that the nation’s drinking water reliably complies with the maximum contaminant levels (MCLs), maximum residual disinfectant limits (MRDLs), treatment techniques (TT) and other requirements stipulated in the Code of Federal Regulations (CFR), 40 CFR Part 141, Subpart B. Section 1445 of the SDWA states that public water systems (PWS) shall conduct monitoring, maintain records, and provide information as needed for the EPA to implement its monitoring and enforcement responsibilities with respect to the Act. Primacy agencies, the EPA and state governments that have assumed primary enforcement responsibility under SDWA section 1413, ensure that PWSs are complying with these regulatory requirements. As part of the PWSS Program, OGWDW uses the Safe Drinking Water Information System (SDWIS) as the database of record for compliance with NPDWR requirements. SDWIS is a database management system that assists the EPA in tracking and interpreting violations data and other program-related data. This ICR provides burden and cost estimates for the final revised Consumer Confidence Report (CCR) rule, including compliance monitoring data (CMD) reporting by primacy agencies. The EPA is finalizing the revised CCR rule to require CWSs serving 10,000 or more people that have violations to include a six month update with their annual report. All other CWSs (without violations) serving 10,000 or more people will be required to reissue their annual report by December 31st. To implement its compliance oversight and enforcement responsibilities under the SDWA, the EPA is finalizing a provision as part of the rulemaking that will require primacy agencies to submit their CMD annually. The ICR estimates costs for future rule implementation.

Abstract

EPA is now proposing certain amendments to the e-Manifest regulations for shipments of hazardous waste that are exported for treatment, storage, and disposal. In addition, EPA proposes regulatory amendments to the three manifest-related, written reports, including: (1) Exception Report, (2) Discrepancy Report, and (3) Unmanifested Waste Report, which address specific issues that arise in the use of the manifest. Because much of the manifest information that is the basis for these separate reports will be available in e-Manifest, EPA is proposing regulatory changes so that these reports can be transmitted electronically and more efficiently in the e Manifest system rather than as separate, written reports. Further, EPA proposes conforming regulatory changes to the Toxic Substances Control Act (TSCA) manifest regulations for polychlorinated biphenyls (PCB) wastes. PCB wastes are not hazardous wastes pursuant to RCRA but are required under TSCA regulations to be tracked under a RCRA hazardous waste manifest when transported from the site of generation to an off-site facility for commercial storage or disposal. Proposed changes to the TSCA manifest regulations are necessary to align with the RCRA manifest regulations and the e-Manifest Program. EPA also proposes regulatory changes to the RCRA hazardous waste export and import shipment international movement document related requirements to more closely link the manifest data with the international movement document data. Finally, the Agency proposes to make technical corrections to fix typographical errors in the e-Manifest and movement document regulations.

HUD requires PHAs to have a valid Declaration of Trust (DOT) recorded against all public housing property. HUD requires PHAs to provide certain submissions when they propose to take certain voluntary actions that change their public housing inventory, such as disposition, demolition, voluntary conversion, required conversion, home ownership, or eminent domain proceedings. Abstract

The FAA’s DroneZone platform (https://dronezone.faa.gov) is the public-facing online hub for UAS activities and information reporting, including safety event reporting. The FAA is continually updating DroneZone to add functionality and improve users’ registration experience. The Safety Event Reporting information collected by the FAA through the DroneZone website, Flight Standards District Offices, one of the Regional Operations Centers, or the Washington Operations Center for each sUAS safety event is used to investigate and determine regulatory compliance. In addition, the safety event information goes into the FAA aircraft accident database for safety analysis purposes by the FAA Office of Accident Investigation and Analysis, pursuant to its statutory safety mission. As is currently the case for manned aircraft accidents, sUAS safety event data will be made available to the public and the National Transportation Safety Board (NTSB). Submission of accident information is mandatory if a small unmanned aircraft safety event meets certain criteria. The affected population consists of small unmanned aircraft operators.

Abstract

This request is for a revision and extension. The revision consists of updating the demographic questions to adhere to the new OMB approved demographic questions under the Statistical Policy Directive on 3/29/24 and updating sample sizes and burden hours based on recent fishing license data. Marine recreational fishing is a popular pastime across the United States (U.S.) that generates economic activity and benefits to local communities, state economies, and to the nation. The National Marine Fisheries Service (NMFS) is required to provide economic data and analysis on recreational fishing for use in fisheries management. The purpose of this data collection is to gather information on marine recreational anglers’ expenditures on fishing trips and durable goods related to fishing. These data are used in fisheries management analyses by state fisheries agencies, regional fishery management councils, and NMFS to understand the economic effects of fisheries regulations and policies. The survey will target marine recreational anglers in all coastal states. As the survey is conducted across all coastal states and specifically targets marine recreational fishing, the benefits are that it can provide comparable data across states and at a national level and is easily available to federal and state agencies who need timely economic information on marine recreational fishing. Results of the survey are also used in NMFS economic reports, by other NOAA and Department of Commerce offices, by academic researchers, and a wide variety of other groups and constituents interested in marine recreational fisheries.
