Information Collection Request (ICR) Tracker

ICR Definition

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

Federal agencies are required to submit an ICR whenever they create, renew, modify, or discontinue an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

Under 47 CFR Section 76.1610, Operators shall inform the Commission on FCC Form 324 whenever there is a change of cable television system operator; change of legal name, change of the operator's mailing address or FCC Registration Number (FRN); or change in the operational status of a cable television system. Notification must be done within 30 days from the date the change occurs and must include the following information, as appropriate: (a) The legal name of the operator and whether the operator is an individual, private association, partnership, corporation, or government entity. See §76.5(cc). If the operator is a partnership, the legal name of the partner responsible for communications with the Commission shall be supplied; (b) The assumed name (if any) used for doing business in each community; (c) The physical address, including zip code, and e-mail address, if applicable, to which all communications are to be directed; (d) The nature of the operational status change (e.g., operation terminated, merged with another system, inactive, deleted, etc.); (e) The names and FCC identifiers (e.g., CA 0001) of the system communities affected.

Abstract

The Department of Education amends the Federal Family Education Loan (FFEL) Program regulations to implement changes Subpart D – Administration of the Federal Family Education Loan Programs by a Guaranty Agency for §682.402(e) and §682.414(b). These final regulations are a result of negotiated rule making and will add new requirements to the current regulations. The final regulations in §682.402(e)(6)(iii) will require that if a FFEL borrower submits an application for discharge that a FFEL program loan holder determines is incomplete, the loan holder will notify the borrower of that determination and allow the borrower 30 days to amend the application and provide supplemental information. The final regulations in §682.402(e)(6)(vii) will require a guaranty agency to issue a decision that explains the reasons for any adverse determination on a false certification discharge application, describes the evidence on which the decision was made, and provides the borrower, upon request, copies of the evidence. The guaranty agency will consider any response or additional information from the borrower and notify the borrower as to whether the determination is changed. The final regulations in §682.402(e)(6)(ix) will provide the borrower with the option to request that the Secretary review the guaranty agency's decision. The final regulations in §682.414(b)(4) will require FFEL Program lenders to report detailed information related to a borrower’s deferments, forbearances, repayment plans, delinquency, and contact information on any FFEL loan to the Department by an established deadline.

Abstract

PBGC’s regulation on Rules for Administrative Review of Agency Decisions (29 CFR part 4003) prescribes rules governing the issuance of initial determinations by PBGC and the procedures for requesting and obtaining administrative review of initial determinations. Certain types of initial determinations are subject to administrative appeals, which are covered in subpart D of the regulation. Subpart D prescribes rules on who may file appeals, when and where to file appeals, contents of appeals, and other matters relating to appeals. Under § 4003.54, an appeal must: (1) be in writing; (2) be clearly designated as an appeal; (3) specifically explain why PBGC’s determination is wrong and the result the appellant is seeking; (4) describe the relevant information the appellant believes is known by PBGC, and summarize any other information the appellant believes is relevant; (5) state whether the appellant desires to appear in person or through a representative before the Appeals Board; and (6) state whether the appellant desires to present witnesses to testify before the Appeals Board, and if so, state why the presence of witnesses will further the decision-making process. Under the regulation, where the appellant believes that another person may be aggrieved if PBGC grants the relief sought, the appeal must include the name(s) and address(es) (if known) of such other person(s).

Abstract

Multichannel Video Programming Distributors (MVPDs) provide their programming over a closed system and, thus, may use all frequencies to do so. They must, however, prevent leakage of those signals from the system and guard against and minimize any harm to aeronautical communications should leak occur. Part of the regime for protecting aeronautical frequencies from interference and resolving interference is notification of the Commission of use of those frequencies and that proper frequency offsets and other precautions are taken. Form 321 is used for this purpose. Under 47 CFR 76.1804, an MVPD shall notify the Commission before transmitting any digital signal with average power exceeding 10-5 watts across a 30 kHz bandwidth in a 2.5 millisecond time period, or for other signal types, any carrier of other signal components with an average power level across a 25 kHz bandwidth in any 160 microsecond time period equal to or greater than 10−4 watts at any point in the cable distribution system on any new frequency or frequencies in the aeronautical radio frequency bands (108-137 MHz, 225-400 MHz). The notification shall be made on FCC Form 321. There are no revisions to the form.

Abstract

In 1997, AHRQ launched an initiative to promote evidence-based practice in everyday care through establishment of the Evidence-based Practice Center (EPC) Program. Since then, the EPCs have been reviewing all relevant scientific literature on a wide spectrum of clinical and health services topics to produce various types of evidence reports. This program directly addresses AHRQ’s abovementioned mission to promote health care quality improvement by conducting synthesis and dissemination of existing scientific evidence for use by various stakeholders. Majority of these evidence reports are systematic reviews (SRs), which are used as evidence bases for clinical practice guidelines, research agenda, healthcare coverage, and other health related policies. Performing SRs is costly in time, labor, and money. Moreover, there is an increasing expectation of quicker turnaround in producing SRs to accommodate the fast moving pace of innovations and new scientific discoveries in healthcare. Some SRs overlap or are replicated; independent teams of SR producers often extract data from the same studies, resulting in replication of work. Current methodology makes it difficult to harness and reuse previous work when updating SRs. An open-access repository of extracted data from primary studies could improve the efficiency of conducting SRs by sharing this extracted data for SR updates or new SRs. A repository of such data would also greatly facilitate methodological research to improve the conduct of SR and primary research. It can foster collaboration, transparency, and reliability among research groups who contribute data. It can also provide valuable information to patients and stakeholders who view the deposited data. In an effort to reduce the economic burden of conducting SRs, the EPC program undertook development of a collaborative, Web-based repository of systematic review data called the Systematic Review Data Repository (SRDR). This resource serves as both an archive and data extraction tool, shared among organizations and individuals producing SRs worldwide, enabling the creation of a central database of SR data. This database is collaboratively vetted, freely accessible, and integrates seamlessly with reviewers’ existing workflows, with the ultimate goal of facilitating the efficient generation and update of evidence reviews, and thus speeding and improving policy-making with regards to health care. The SRDR project aims to achieve the following goals: 1) Create online easy-to-use Web-based tools for conducting systematic reviews to facilitate extraction of data from primary studies; 2) Develop an open-access searchable archive of key questions addressed in systematic reviews; 3) Maintain a public repository of primary study data including provision of technical support for repository users; and 4) Develop a process for making summary data from systematic reviews digitally shareable to end-users.

Abstract

The Department of Education proposes to amend the Student Assistance General Provisions regulations issued under the Higher Education Act of 1965, as amended (HEA), to implement changes made to the Student Assistance General Provisions regulations – Subpart D – Institutional and Financial Assistance Information for §668.41 - Reporting and disclosure of information. These final regulations are a result of negotiated rulemaking and would delete requirements to the current regulations in §668.41(h). The current regulations in §668.41(h) require institutions that use pre-dispute arbitration agreements or class action waivers as a condition of enrollment disclose that information to students, prospective students, and the public in an easily accessible format. The final regulations in §685.300 contain provisions which would replace those in current §668.41(h), rendering it unnecessary. This request is to remove from the current information collection the regulatory requirements, burden hours, and costs associated with the regulations in §668.41(h) while retaining the burden hours previously calculated for the remaining sections of §668.41.

Abstract

On July 10, 2019 the Commission adopted a Report and Order in MB Docket Nos. 18-202 and 17-105, FCC 19-67, Children’s Television Programming Rules; Modernization of Media Regulation Initiative. Under the Children’s Television Act of 1990 (CTA), the Commission is required to consider, in its review of television license renewals, the extent to which the licensee “has served the educational and informational needs of children through the licensee’s overall programming, including programming specifically designed to serve such needs.” The Commission initially adopted rules implementing the CTA in 1991, and revised these rules in 1996, 2004, and 2006. In the Report and Order, the Commission revises the children’s television programming rules in light of changes to the media landscape that have occurred since the children’s television programming rules were first adopted. 47 CFR Section 76.1703 requires that cable operators airing children’s programming maintain records sufficient to verify compliance with 47 CFR Section 76.225 and make such records available to the public. Such records must be maintained for a period sufficient to cover the limitations period specified in 47 U.S.C. Section 503(b)(6)(B). In the Report and Order, the Commission revises the rules to permit cable television operators to file their certifications of compliance with the commercial limits in children’s programming annually rather than quarterly and to permit the filing of these certifications within 30 days after the end of the calendar year.

Abstract

On July 10, 2019, the Commission adopted a Report and Order and Further Notice of Proposed Rulemaking in MB Docket Nos. 17-105 and 18-202, FCC 19-67, In the Matter of Children’s Television Programming Rules; Modernization of Media Regulation Initiative. The Report and Order revises the children’s television programming rules to provide broadcasters additional scheduling flexibility, allow broadcasters to offer more diverse and innovative educational programming, and relieve unnecessary burdens on broadcasters. Among other revisions, the Report and Order expands the Core Programming hours to 6:00 a.m. to 10:00 p.m.; modifies the safe harbor processing guidelines for determining compliance with the children’s programming rules; requires that broadcast stations air the substantial majority of their Core Programming on their primary program streams, but permits broadcast stations to air up to 13 hours per quarter of regularly scheduled weekly programming on a multicast stream; eliminates the additional processing guideline applicable to stations that multicast; and modifies the rules governing preemption of Core Programming. In addition, the Report and Order revises the children’s programming reporting requirements by requiring that Children’s Television Programming Reports (FCC Form 2100, Schedule H) be filed on an annual rather than quarterly basis, within 30 days after the end of the calendar year; eliminating the requirements that the reports include information describing the educational and informational purpose of each Core Program aired during the current reporting period and each Core Program that the licensee expects to air during the next reporting period; eliminating the requirement to identify the program guide publishers who were sent information regarding the licensee’s Core Programs; and streamlining the form by eliminating certain fields. The Report and Order also eliminates the requirement to publicize the Children’s Television Programming Reports. The Report and Order directs the Media Bureau to make modifications to FCC Form 2100, Schedule H as needed to conform the form with the revisions to the children’s programming rules, including the changes to the processing guidelines and preemption policies.
