ICR Definition

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

Federal agencies are required to submit an ICR whenever they create, renew, modify, or discontinue an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

On July 10, 2019, the Commission adopted a Report and Order and Further Notice of Proposed Rulemaking in MB Docket Nos. 17-105 and 18-202, FCC 19-67, In the Matter of Children’s Television Programming Rules; Modernization of Media Regulation Initiative. The Report and Order revises the children’s television programming rules to provide broadcasters additional scheduling flexibility, allow broadcasters to offer more diverse and innovative educational programming, and relieve unnecessary burdens on broadcasters. Among other revisions, the Report and Order expands the Core Programming hours to 6:00 a.m. to 10:00 p.m.; modifies the safe harbor processing guidelines for determining compliance with the children’s programming rules; requires that broadcast stations air the substantial majority of their Core Programming on their primary program streams, but permits broadcast stations to air up to 13 hours per quarter of regularly scheduled weekly programming on a multicast stream; eliminates the additional processing guideline applicable to stations that multicast; and modifies the rules governing preemption of Core Programming. In addition, the Report and Order revises the children’s programming reporting requirements by requiring that Children’s Television Programming Reports (FCC Form 2100, Schedule H) be filed on an annual rather than quarterly basis, within 30 days after the end of the calendar year; eliminating the requirements that the reports include information describing the educational and informational purpose of each Core Program aired during the current reporting period and each Core Program that the licensee expects to air during the next reporting period; eliminating the requirement to identify the program guide publishers who were sent information regarding the licensee’s Core Programs; and streamlining the form by eliminating certain fields. The Report and Order also eliminates the requirement to publicize the Children’s Television Programming Reports. The Report and Order directs the Media Bureau to make modifications to FCC Form 2100, Schedule H as needed to conform the form with the revisions to the children’s programming rules, including the changes to the processing guidelines and preemption policies.

Such records must be maintained for a period sufficient to cover the limitations period specified in 47 U.S.C. Section 503(b)(6)(B). In the Report and Order, the Commission revises the rules to permit cable television operators to file their certifications of compliance with the commercial limits in children’s programming annually rather than quarterly and to permit the filing of these certifications within 30 days after the end of the calendar year.

Abstract

Section 226(c)(1)(A), 47 CFR Section 64.703(b) provides that aggregators (providers of telephone to the public or transient users) must post in writing, on or near such phones, information about presubscribed operator services, rates, carrier access, and the FCC address to which consumers may direct companies. Section 64.703(c) establishes a 30-day outer limit for updating the posed consumer information when an aggregator has changed the presubscribed operator service provider.

Abstract

On June 7, 2019, the Commission released a Report and Order and Second Further Notice of Proposed Rulemaking (Report and Order and Second FNPRM), In the Matter of Leased Commercial Access; Modernization of Media Regulation Initiative, MB Docket Nos. 07-42 and 17-105, FCC 19-52. The Report and Order first vacates the Commission’s 2008 leased access order, 23 FCC Rcd 2909, which never went into effect. Second, the Report and Order adopts certain updates and improvements to the Commission’s existing leased access rules. The rule changes that are relevant to this information collection are changes to sections 76.970(h) and 76.975(e).

Abstract

The Department of Education (the Department) amends the Student Assistance General Provisions regulations to implement changes to §668.43 – Financial assistance information . These changes are based on requirements of Section 485(a)(1)(G) of the Higher Education Act of 1965, as amended, (HEA). These final regulations are a result of negotiated rulemaking in 2021 and add new requirements to the current regulations. The final regulations in §668.43 would put in place new institutional disclosure requirements for participants in the proposed Prison Education Program (PEP). Specifically, §668.43(a)(5)(v) is amended to require disclosure of typical State or Federal prohibitions on the licensure or employment of formerly confined or incarcerated individuals for a PEP that is designed to meet educational requirements for a specific professional license or certification. This information is required for licensure requirements in States other than the State where the correctional facility is located or the State where most students are likely to return.

Abstract

This consolidated ICR involves reporting and recordkeeping activities established under TSCA section 8 for chemical substances. Although imposed for a specific chemical substance, the activities are already established and only vary based on the specific authority under TSCA section 8 and the need for the information for that chemical. EPA is consolidating ICRs currently approved under control numbers 2070-0004, 2070-0017, and 2070-0054, and formerly approved under 2070-0067 to streamline the presentation of the paperwork burden estimates for these various activities, which will in turn facilitate and reduce the administrative burden for both the public reviewers and the Agency in terms of reviewing and updating the ICR every three (3) years as required by the Paperwork Reduction Act (PRA), 44 U.S.C. 3501 et seq., as well as allow for a better assessment of the paperwork burden and costs associated with reporting and recordkeeping activities established under TSCA section 8 for specific chemical substances. This information collection request (ICR) covers reporting and recordkeeping requirements imposed under the authorities in section 8 of the Toxic Substances Control Act (TSCA), 15 U.S.C. 2607, for persons who manufacture (the term manufacture includes import under TSCA) or process chemical substances, mixtures, or categories, or distribute them in commerce. The purpose of the information collection activities is to collect data that will help the Agency evaluate the potential for human health and environmental risks that may be caused by the manufacture, processing, and distribution in commerce of chemical substances, mixtures, or categories. This ICR addresses the following four (4) types of information collections (ICs) required by TSCA section 8 and identifies the persons required to keep records and report such information. The ICs are numbered to facilitate the presentation in the ICR and link to supporting information; and the numbering is not otherwise intended to convey any sequencing or prioritization.

Abstract

Enrollment data is an important source of information which allows the Indian Affairs and other Federal agencies to equitably distribute resources because it is a quantifiable representation of a Tribe’s population. Different population sizes generally require different levels of services and resources. BIA must collect this information to ensure effective, accurate, and timely distribution of assistance to respond to funds specifically appropriated for Indian Country, where applicable. This data will assist Federal agencies in developing distribution formulas for funds under annual appropriations, Inflation Reduction Act of 2022 (P. L. 117-169), or Infrastructure Investment and Jobs Act (P.L. 117-58).

The 2022 FHWAR will result in a comprehensive database of fish and wildlife-related recreation activities and expenditures. It will provide comparable statistics not available from other sources. The survey information helps us effectively administer fish and wildlife restoration grant programs, and helps states develop project proposals and conservation programs. Data are used to evaluate the status and trends of recreational uses as well as the values and benefits of fish and wildlife resources. The data provide essential information on present recreation demands and serve as a basis for projecting future demands.

Abstract

The Department of Labor (Department), Employment and Training Administration (ETA) is submitting this Information Collection Request (ICR) to implement and collect an annual Reemployment Services and Eligibility Assessment (RESEA) state plan as described in Section 306(e) of the Social Security Act (SSA). On February 9, 2018, the President signed the Bipartisan Budget Act of 2018, Public Law 115-123 (BBA), which included amendments to the SSA that create a permanent authorization for the RESEA program. Section 306 of the SSA introduced several new program requirements including the requirement that states must submit an annual state plan to be considered eligible for funding. To be considered eligible for RESEA funding for a Fiscal Year, a state must submit a state plan that outlines how the state intends to conduct a program of reemployment services and eligibility assessments by responding to all the required elements identified in Section 306(e) of the SSA and this ICR.
