Information Collection Request (ICR) Tracker

ICR Definition

An Information Collection Request (ICR) is a federal agency’s request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

Federal agencies are required to submit an ICR whenever they create, renew, modify, or discontinue an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

ICRs are publicly available on RegInfo.gov, and additional guidance can be found in the FAQs.

Abstract

As required by the CMS-9989-F: Establishment of Exchanges and Qualified Health Plans; Exchange Standards for Employers ("Exchange rule"), each Exchange must assume responsibilities related to the certification and offering of Qualified Health Plans ("QHP"). To offer insurance through an Exchange, a health insurance issuer must have its health plans certified as QHPs by the Exchange. A QHP must meet certain minimum certification standards, such as network adequacy, actuarial value standards, and the offering of the essential health benefits (EHB). The Exchange is responsible for ensuring that QHPs meet these minimum certification standards as described in the Exchange rule under 45 CFR 155 and 156, based on the Affordable Care Act, as well as other requirements determined by the Exchange.

HRSA Federal Office of Rural Health Policy created a quarterly, aggregate data report to collect information on COVID-19 testing and mitigation activities conducted by small rural hospitals receiving SHIP funding. Respondents are SHIP grantees or their small rural hospitals who received funding for COVID-19 testing and mitigation related expenses. HRSA issued funding as one-time payments to 46 state offices of rural health based on the number of eligible hospitals, providing $258,376 per hospital (1540 hospitals total across the country). The organizations were identified by CMS Certification Numbers (CCN). Data report information is needed to comply with federal requirements to monitor funds distributed under the American Rescue Plan Act.

Abstract

Extension of this approved collection is requested. Pursuant to the High Seas Driftnet Fishing Moratorium Protection Act (MPA) or the Marine Mammal Protection Act (MMPA), certain fish products may be excluded from U.S. markets. If certain fish or fish products of a nation are subject to import prohibitions (e.g., harvest of a particulary fishery), the National Marine Fisheries Service (NMFS) requires that other fish or fish products from that nation that are not subject to the import prohibitions must be accompanied by certification of admissibility. A duly authorized official/agent of the applicant’s Government must certify that the fish being imported into the U.S. are of a species, or from a fishery, that is not subject to the import restriction. If a nation is identified under the MPA and fails to receive a positive certification decision from the Secretary of Commerce, products from that nation may be prohibited, and other products not subject to the import prohibitions must be accompanied by certification of admissibility. Likewise, if a nation does not receive a comparability finding for a fishery under the MMPA, products from that nation's fishery may be prohibited and products from other fisheries that are not subject to the import prohibitions must be accompanied by the certification of admissibility.

Abstract

The OCC is revising and requesting a new OMB control number for its form titled “Qualifying Activities Confirmation Request Form,” which is currently approved under OMB Control No. 1557-0160. The form was created to address the need for a qualifying activities confirmation process that allows banks and interested parties to ascertain whether an activity qualifies under CRA. The process was well received and strongly supported among commenters on the OCC ANPR and NPR that resulted in the 2020 final rule. We believe that there remains widespread support for such a system. Based on these considerations, the OCC determined that it was important to implement a better designed system that more effectively and efficiently allows confirmation of qualified activities. A marked copy is included with the IC reflecting the changes to the form.

Abstract

The National Emission Standards for Hazardous Air Pollutants (NESHAP) for Flexible Polyurethane Foam Product (40 CFR Part 63, Subpart III) apply to owners or operators of both new and existing facilities that engage in the manufacture of flexible polyurethane foam products which emit hazardous air pollutants (HAPs). This includes facilities making slabstock flexible polyurethane foam (slabstock foam), rebond flexible polyurethane foam (rebond foam), and/or molded flexible polyurethane foam (molded foam). In general, all NESHAP standards require initial notifications, performance tests, and periodic reports by the owners/operators of the affected facilities. Owners or operators of flexible polyurethane foam production facilities to which this rule is applicable must choose one of the compliance options described in these standards or reduce HAP emissions to below the compliance level. Specifically, the rule requirements for slabstock foam producers include an initial notification, notification of compliance status, semiannual reports and annual compliance certifications. The rule requirements for molded and rebond foam producers include a notification of compliance status report and an annual compliance certification. These notifications, reports, and records are essential in determining compliance with 40 CFR Part 63, Subpart III.

The Patient Protection and Affordable Care Act, Public Law 111-148, enacted on March 23, 2010, and the Health Care and Education Reconciliation Act, Public Law 111-152, enacted on March 30, 2010 (collectively, “Affordable Care Act”), expands access to health insurance for individuals and employees of small businesses through the establishment of new Affordable Insurance Exchanges (Exchanges), including the Small Business Health Options Program (SHOP). The Exchanges, which became operational on January 1, 2014, enhanced competition in the health insurance market, expanded access to affordable health insurance for millions of Americans, and provided consumers with a place to easily compare and shop for health insurance coverage. Benefit Plans, Eligibility Notices, Fair Hearing and Appeal Processes, and Premiums and Cost Sharing; Exchanges: Eligibility and Enrollment (CMS-2334-F) address: (1) standards related to notices, (2) procedures for the verification of enrollment in an eligible employer-sponsored plan and eligibility for qualifying coverage in an eligible employer-sponsored plan; and (3) other eligibility and enrollment provisions to provide detail necessary for state implementation. The submission seeks OMB approval of the information collection requirements Sections 1311(b) and 1321(b) of the Affordable Care Act provide that each state has the opportunity to establish an Exchange that (1) facilitates the purchase of insurance coverage by qualified individuals through QHPs; (2) assists qualified employers in the enrollment of their employees in QHPs; and (3) meets other standards specified in the Affordable Care Act. Section 1311(k) of the Affordable Care Act specifies that Exchanges may not establish rules that conflict with or prevent the application of regulations promulgated by the Secretary. Section 1311(d) of the Affordable Care Act describes the minimum functions of an Exchange, including the certification of QHPs.

(TD 8531) These regulations provide rules for the treatment of options under IRC section 382 for purposes of determining whether a corporation undergoes an ownership change. The regulation allows for certain elections for corporations whose stock is subject to options.

Why They Are Important

ICRs play a vital role in ensuring transparency and accountability in federal data collection. When federal agencies collect information from 10 or more "persons" (which includes individuals, businesses, and state, local, and tribal governments), they must submit an ICR to ensure that it fulfills their statutory missions, avoids unnecessary or duplicative requests, and minimizes burden on the American public. Additionally, Federal Register Notices (FRNs) and the opportunity for public comments provide a formal way for the public to be informed of proposed ICRs and participate in the process.

ICRs also serve as a key resource for tracking changes to federal data collections. The availability of detailed documentation, such as data collection instruments and methodologies, allows the general public to identify revisions in a timely manner. These may include revisions prompted by Executive Orders or statistical policies like OMB's Statistical Policy Directive No. 15 (SPD 15), which are often submitted as "nonsubstantive" or "nonmaterial" changes to a currently approved collection.[1] Furthermore, ICRs can help determine if a data collection has expired without renewal or has been intentionally discontinued. By reviewing ICRs, the public can better understand what data is being collected, how it evolves over time, and whether data collections have become inactive–often in response to shifting priorities and updated standards.

How To Use The Tool

The ICR tracking tool offers a user-friendly view of ICRs that have been recently submitted, reviewed, or are nearing expiration. By aggregating key data from individual ICRs, the tool allows users to view the current status of each request, including submission, conclusion, and expiration dates, details on whether any changes were made, authorizing statutes, and more. Users can search for specific information and filter results based on various criteria. If seeking additional information, various text fields are hyperlinked to the full ICR on RegInfo.gov and associated resources.
